In Korea, the real estates markets have been regarded as targets of direct investment, and therefore, various social problems including biased wealth and lack of market principle have arisen. The policies of the government have been focused on passive regulations for prevention of speculations, retarding the development of the real estate markets.
Such conditions have lead to more problems, while companies suffering from the IMF bailout program attempted to dispose their real estates into the markets in order to overcome their financial difficulties, and as a result, nation's economy suffers from a more serious crisis, primarily due to the poor liquidity of real estates. In order to solve such problems, a trust-type REITs was introduced according to "Trust Business Code" in April, 1998, "ABS" was launched in September, 1998 with enactment of "Asset Liquidity Code", and "MBS" was introduced according to "MBS Liquidity Business Code" in January, 1999, but such systems have been found limited in floating the real estates.
In order to overcome such limits, ordinary REITs and business restructuring REITs were introduced according to "REITs Business Code" in July, 2001. This new system is expected to provide the small investors with an opportunity to own a large promising real estate, expand the job opportunities due to development of real estate service businesses, stabilize people's housing life with increased rental houses, enhance the service quality due to competition among REITs businesses, and create a variety of rental house markets meeting consumers' needs.
However, like other systems, it is questionable that the REITs system would be smoothly established in our real estate markets, because it is a new and strange system. On the other hand, although the new REITs system was launched with the expectation that our real estate markets and capital markets would be advanced to be helpful to restructuring of companies and financial institutions, few ordinary REITs companies have been established against the expectation, which may be attributable to several problems inherent in REITs business system. In order to solve such problems, the following solutions are suggested.
First, in order to activate the operation of REITs, it is essential to allow for investments in kind, expand the real estate development projects gradually, allow for partial financing of the projects, and find more real estates for investments and increase their profits. Second, it is necessary to foster professional manpower. To this end, investment analysts system needs to be introduced, while real estate service people's certification system be improved with a systematic fostering of professional manpower. Third, in order to effectively operate REITs companies, it is required of them to be correctly informed of the real estate markets.
Therefore, an open information system should be constructed, while efforts be exerted to enhance the public reliability of real estate assessors. Fourth, current tax system needs to be reformed. Since REITs companies should be able to make profits, more tax incentives need to be extended to them. Fifth, it is deemed necessary to strike a balance of development between ordinary and company restructuring REITs. If the current system in favor of the latter should continue, ordinary REITs businesses would be retarded, and then, the cause of REITs businesses would be tarnished.
Many advanced nations who introduced the REITs system had suffered from various trials and errors at the initial stage, but they have successfully established the new system. In order to minimize such trials and errors and thereby, establish the REITs system successfully, it is required of companies and financial institutions to restructure their businesses successfully, while the government is obliged to activate the real estate investments and develop the real estate industry as an effective means of balanced regional developments.
