This study examines the legal contradictions and issues of tax equity arising from the conflict between the principle of individual-based taxation and the special provisions for single-householder households under the Comprehensive Real Estate Tax Act, focusing on the recent Supreme Court Decision 2025Du33779 rendered on September 11, 2025 (the "Subject Decision").
In the Subject Decision, the Supreme Court interpreted the requirements for applying the special provision for "low-priced rural housing" under Article 8, Paragraph 4, Subparagraph 4 of the former Act by limiting it strictly to ownership by the "taxpayer themselves." Consequently, in cases where one spouse owns a primary residence and the other acquires a low-priced rural house due to employment in a provincial area, the spouse owning the primary residence is restricted from receiving full deductions under Article 8, Paragraph 1 and is disqualified from tax credits for the elderly or long-term holdings.
This results in a severe tax burden disparity—potentially up to 4.4 times higher—compared to cases where the rural house is acquired under the name of the spouse who already owns the primary residence. This paper identifies the root cause of these issues in the individual-based taxation system introduced following the 2008 Constitutional Court’s decision of unconstitutionality. Under a progressive tax rate structure, a choice must be made between i) equality between married and unmarried individuals and ii) equality between households. This study argues that if the National Assembly chose the latter, the Constitutional Court should have respected that legislative discretion.
Paradoxically, the individual-based taxation forced by the Court’s decision has become a tax-saving tool for high-net-worth individuals through name-splitting, while adversely affecting middle-class households. This undermines the value of the separate property system for spouses and infringes upon the freedom of marriage and freedom to choose an occupation. In conclusion, this study calls for legislative amendments to expand the scope of ownership under Article 8, Paragraph 4 to include household members, aligning with the legislative purpose of the Comprehensive Real Estate Tax and the ability-to-pay principle.
Furthermore, it urges a proactive judicial reconsideration of the individual-based taxation principle and a purposive interpretation by the courts.
