The Korean Land Registration Act discloses personal information such as the right owner’s Resident Registration number and address without exception. However, the public interest in disclosing personal information in land registries and the protection of personal information are competing interests, and the disclosure of personal information may be limited under the principle of proportionality.
This article examines from a comparative legal perspective how Germany, Austria, the Netherlands, New Zealand, and Japan have legislated to protect personal information, especially addresses, and derives policy implication from them. In conclusion, land registration system should disclose personal information necessary to identify the owner for safe transactions, but disclosure of personal information is not justified to the extent that it poses a risk to the owner. Relying on an abstract standard such as “legitimate interest in withholding information” is likely to increase the administrative burden on the registrars, so concrete guidelines should be codified in law.
The Netherlands, New Zealand, and Japan have taken a stance that limits the disclosure of personal information in registries only when a specific risk has been identified. However, restricting the disclosure of personal information only when a specific risk has been identified is insufficient to protect victims, as the public is allowed to access the registry in principle. Therefore, it is necessary to disclose the resident registration number and address both partially from the beginning to protect personal information while allowing identification of the land owner for those who have a legitimate interest in it.
