초록
The purpose of this study for seeking changes in the ownership and utilization of farmland is as follows. The first goal is reinterpreting and innovating a principle of farmer ownership reasonably about recent agricultural land act and administrative system of support and regulation. The second goal is identifying the major problems of land ownership and utilization. The third goal is seeking institutional improvements by finding alternatives and ways. There has always been a problem with land ownership and farming on the ground.
The problem of conflict between ownership and farming rights is likely to worsen in the farmland ground where lease relationship works practically and generally nowadays. Farmland ownership and utilization are labeled by recent agricultural land act. However, the utilization is regulated by traditional principle of farmer ownership and restrictions. Restrictions are placed on the entry of owners and on their acquisition by placing an upper limit on their ownership. The right to use land, such as land leasing cultivation, which is realistically prevalent is not activated sufficiently, and the tenant's right to farm has its institutional defect and limitations as a protected right.
These agricultural issues are critical to the site of farmland use. And these are connected with the direct economic life with the national economy and resolve the conflict of rights to greatly affect the industrialization of future agriculture, and to sufficiently develop agriculture as a future food industry to support the development of the industrial fields of advanced countries. So problems with legal and institutional sites of the rights to own and use farmland should be solved. Thus, the act on the promotion of farmland preservation and utilization shall be promoted by improving the laws and systems of farmland that restrict the ownership and utilization of farmland.
Therefore, the rationalization of farmland system should be facilitated in the direction of absolute preservation of farmland. The principle of economic freedom on legislation should be reinterpreted and reestablished. And introducing the amendment to the economic flexibility that is currently being discussed in the National Assembly, the principle of agricultural land should be based on public opinion and future flexibility. And, it is required to actively supplement the utilization of the farm lease, consignment, and land trust system by improving the formal procedures for the qualification of farmland self-assertion during the acquisition stage.
Policies should be emphasized primarily on the sustainable conservation of good farmland along with the activation of land ownership and utilization through such institutional improvements. Within Agriculture Promotion Zone, land that can not be used for exclusive use should be designated as exclusive forbidden areas to strictly regulate farmland use and to induce professional farming in the form of economic units. Within an agricultural protected area, individual farming projects, focusing on returning home or retired farmers, can be politically induced to become selective and restricted areas that can be designated only within the minimum required for farming.
It will be necessary to develop a comprehensive farming industry policy that encourages young farmers to actively train farming farmers, farmers and farming communities, and contribute to the creation of agricultural jobs in the country. Agriculture is conducting a public interest function that discriminates against other industries, such as food security, conservation of natural environment, and preserving traditional culture. The basis of such agriculture was farmland as land.
Therefore, the values of agricultural land today and tomorrow must be considered deeply through the past, in preserving, using, and possessing, the natural, public interest, and cultural properties of such an important farmland. The amendment aims to reform farmland or the system of agricultural and fishing villages to facilitate future generations and propose ways to improve the ownership and utilization of farmland, thereby proposing to propose improvements as a practical and futuristic farmland system. Along with such measures for improvement of the system, the act reflected mid-to long-term tasks of land ownership and utilization and improved system.
It is also intended to leave unfinished secondary research tasks on the farmland system within the scope of its ability to function as a researcher. Hopefully, researchers alternative to improving systems for land ownership and utilization at agricultural sites will help little to improve the site of our agricultural system.
