주택조합제도의 운영 문제와 개선 방안을 사례 중심으로 고찰했다.
초록
The previous Housing Association System based on workshop and location has a positive aspect that houseless people easily can have an apartment, but it also has a lot of side effects such as association troubles and no transparencyin business operation leading to the delay or interruption of the business. There has been discussion related to these problems. As a result, recently there was a legal revision that most solutions discussed before were included as theHousing Construction Promotion Act changed to Housing Act. The purpose of this study is to demonstrate the problems of the previous Housing Association System and to suggest solutions.
In chapter one, the meaning, history, and legal character of the housing association are described and the process of the business is drawn up in a legal revision order. In chapter two, legal points at issue while proceeding the Housing Association System are divided into 6 categories: promotion committee, the qualification of the houseless person, association agreement, how to preserve the project site, legal problems related to union dispersion, and the legal character of approval of union composition. Studied and leading cases in each category are also demonstrated.
In chapter three, the Joint Housing Association System in Jamwon-Dong is demonstrated to analyze the problems of the housing association in next chapter. In chapter four, the problems of the Jamwon Joint Housing Association System are analyzed and solutions to these problems, which the revised regulation mostly adopted, are introduced. However, solutions in the revised regulation are not enough to deal with all problems, so I suggested additional solutions. When the Housing Act was changed, there were a lot of reduction and cancellation of the business based on the previous Housing Association System.
However, unless we solve the problems of the housing association, we are going to have the same problems as we had. That's why the new system has to be successfully established so that we have no more previous problem
