韓國에서의 不動産 仲介業의 改善方案에 關한 硏究

국내 부동산 중개업의 현황과 개선방안을 연구했다.

不動産은 우리 사회의 일반 국민에게 자산의 대부분을 차지하고 있다. 또한 국민은 대부분의 不動産을 不動産 仲介業所를 통해서 去來하고 있다. 不動産은 일반국민이 소유하는 재산 중에서 가장 비중이 크고 또한 인간 사회 생활의 중요한 기반이 되므로 이들의 去來는 공평하고 안전하게 또한 원활히 행해져야 한다는 인식이 높다. 국민의 經濟성장과 더불어 대두된 不動産 經濟는 이제 국가經濟에서의 매우 중요한 부분이 되고 있다. 이러한 不動産 經濟에 있어서 不動産 仲介市場이 차지하는 비중 또한 크다고 볼 수 있다. 그러나 이러한 不動産 仲介분야가 그 규모 면에서 국민經濟에 차지하고 있는 範圍와 일반 국민의 삶과 아주 밀접한 관계를 가지고 있음에도 부정적인 이미지로 남아있는 것은 안타깝다. 우리나라가 産業구조를 통해 不動産 産業에도 영향을 미치고 있다. 사회의 급격한 변화로부터 不動産 서비스업이 하나의 고도지식産業으로 자리 잡아 가고 있다. 아울러 선진국을 중심으로 해서 不動産市場의 國際化가 하나의 흐름으로 가는 추세이다. 또한 産業구조 조정기를 통해서 선진국들은 不動産의 情報化와 지식화를 촉진했으며 不動産 유통부분의 근대화를 꾀하고 전 세계적 네트워크를 구축해서 종합적인 不動産 서비스를 제공하는 거대화 회사가 출현하고 있는 실정이다.

따라서 우리나라 不動産 仲介業界는 선진技法으로 무장된 外國 不動産 유통업체와의 경쟁과 더불어 현재 이루어지고 있는 인터넷, PC통신, 생활정보지를 이용한 不動産 직去來의 파장도 우려하는 것이다. 그러나 우리나라의 不動産 서비스업은 다른 서비스업과는 달리 아주 작은 업무에 있어서조차 수많은 전문 직업인이 참여하는 구조로 되어 있고 투기억제 등 政府의 정책목표 달성을 위해 겸업제한을 비롯한 각종 규제를 받고있어 효율적이고 종합적이며 수요자의 요구에 부응한 서비스가 이루어지지 못한 채 영세한 규모에서 이루어지고 있다. 이는 우리나라 仲介業이 복덕방으로부터 발달해온 것이라는 역사적 過程에 있고 한국經濟의 기형적 발전過程으로부터 기인한 不動産투자와 투기에 따른 不動産 브로커의 난립과 이에 편승한 不動産 業者들의 행동 그리고 영세한 仲介業에 있다고 볼 수 있다. 현대 사회는 빠르게 변하고 있다. 새로운 經濟체제로의 전환은 우리經濟의 패러다임이 새롭게 바뀌고 있음을 의미한다. 이러한 변화는 不動産 市場에서 엄청난 변화를 나타내고 있다. 不動産은 국가 또는 개인 등의 귀중한 재산일 뿐만 아니라 공적으로 이용되는 귀중한 재산이다. 따라서 不動産仲介業制度는 우리 사회와 아주 밀접한 관계를 유지하고 있으므로 사회발전과 보조를 맞추는 것이 보통이다. 그러나 우리나라 不動産 仲介制度는 이와는 달리 낙후되어 있어 영세성을 면치 못하고 있는 실정이다.

不動産 仲介業은 국민의 재산을 去來함으로서 국민의 생활 안정과 복지향상 및 국토이용의 효율화를 부담할 선도적인 입장에 있는 업종이다. 이러한 가운데 不動産 서비스 市場 開放을 맞아 不動産 仲介業界로서는 대내적, 대외적 仲介士 制度의 확고한 정립으로 실추된 仲介業界의 위상을 제고하여 전문직으로 삼아야하며 대외적으로는 선진外國의 발달된 서비스에 대비하여 경쟁력을 갖추어 仲介業의 선진화, 기업화, 전문화에 총력을 기울여야 하겠다. 또한 不動産 仲介業이 전문 업종으로 사회적 신뢰도를 갖기 위해서는 무엇보다 不動産 仲介業者 자신의 끝없는 고도화된 전문지식을 갖추어 나가야 한다. 따라서 不動産 仲介制度의 전반적인 분석과 國際化, 情報化를 통한 우리나라 不動産 仲介業의 改善方案을 제시하고자 한다. Real estate takes the most of the property of ordinary Korean people. Moreover, Koreans are involved in real estate agents for the business of their real estate.

Real estate is an important base of people living their lives, thus it is thought that the business of real estate should be done equally, safely and easily. In this real estate economy, the gravity of real estate business market is also great. Yet, it is distressing that although real estate business has a vast range in national economy and a close relation with Koreans life, it is still left in a negative image. Real estate business is also influenced by industrial structure in Korea. Since the society is rapidly changed, real estate service business takes root as one high knowledge-based industry.

In addition, internationalization of real estate market tends to be one trend centering developed countries. Furthermore, developed countries promoted information and knowledge system of real estate through industrial structure adjustment period, and attempted of modernization in real estate circulation area. Additionally, they established worldwide network and a major company providing general real estate service has been born.

Therefore, real estate business circle in Korea worries about close of real estate business done directly due to content with foreign real estate companies armoring with new technologies and also internet, PC communication and information magazines used at the moment. However, the structure of real estate service in Korea is that numerous experts take part in any minor business unlike other service business, and it is regulated to hinder speculation and real agents cannot have other jobs at the same time. Therefore, real estate business in Korea done within a poor and small scale without providing services meeting peoples demand.

It can be explained from the fact that Korean real estate agents are in a developing step, flood with real estate brokers in accordance with the speculation of real estate caused by deformed development process of Korean economy, action of real estate agents joining the speculation, and poor real estate business. Modern society is changing rapidly. Changing to new economic system means that Korean economic paradigm is being newly changed. This change shows great change in real estate market. Real estate is not only a very important property of a nation and people but also used as a public property.

A real estate business system has a close relation with people in a society, thus it is general that the system keeps step with the development of the society. However, Korean real estate business system cannot avoid poor situation. Real estate business is in the top of responsible of providing a stable life for people, wealth improvement and effect utilization of land. As real estate service market is open, real estate business should be specialized by considering the downgraded status of real estate business by firm establishing of internal and external real agents system.

Moreover, it should have competitive power for services of developed countries so that real estate business can be modernized, industrialized and specialized. Additionally, to allow real estate business to have social reliability as a special area, real estate agents themselves should have deep knowledge. Therefore, there should be great effort so that Korean real estate business can be developed in internalized information world.
