지적공부 미등록토지 정비 및 정리에 관한 연구

지적공부에 등록되지 않은 토지의 정비·등록 방안을 검토했다.

Unregistered land resurvey and its registration in cadastral records become important in terms of improving public trust. The importance of registration and arrangement of unregistered land in cadastral maps has been highlighted. The registration and arrangement are essential to increase the reliability of the cadastral record, which also influences the public trust. Therefore, this study is to review how to improve the public trust through unregistered land resurvey and its registration in the cadastral record. This study focuses on unregistered land in cadastral map especially in Chungcheongbukdo province.

Methodologically, the primary and secondary data are collected through literature reviews and an online search and both descriptive and systematic approaches are used. The research results are driven from the following perspectives. First, unregistered land and framework are approached in terms of target and arrangement of unregistered land, literature reviews and framework. Second, the current status of unregistered land is reviewed based on simple arrangement, new registration and correction of registration in terms of errors in cadastral maps. Third, a strategy for registration and arrangement of unregistered land is suggested based on the results of review.

지적도에 미등록 된 토지 등에 대한 일제 조사 및 지적공부 등록 완료를 통하여 지적공부 및 토지소유권 관리로 대 국민 신뢰도 향상이 요구되는 시점에 다다르고 있다. 즉 지적도 상에 나타나지 않는 토지의 중요도가 그 어느 때 보다 중요시되고 있는 현 시점에 정비의 필요성이 부각되고 있고 정리를 통한 지적공부의 신뢰도를 높이며 국민의 신뢰도 향상이 강력히 필요하게 되었다. 따라서 본 연구는 지적도에 미등록된 토지를 일제히 조사하여 지적공부에 등록 및 관리를 통하여 국민의 신뢰도 향상을 기하는 것이다. 이를 위한 연구범위는 지적공부에 미등록된 토지로 한정하고 그 대상은 충북의 미등록 된 토지로 한정하고자 한다. 조사방법은 문헌조사 및 인터넷 조사를 통하여 1차 및 2차 자료를 수집하며, 접근방법은 서술적 접근방법과 체제론적 접근방법을 병용하고자 한다. 연구 결과는 다음과 같은 관점 및 내용에서 도출하고자 한다. 첫째, 미등록 토지와 접근 틀은 미등록토지 대상 및 정비, 선행연구, 접근 틀 차원에서 검토하게 된다. 둘째, 미등록 된 토지의 현황은 지적도 오류에 따른 실제 현황을, 단순 정비 및 신규등록, 등록사항정정 차원에서 파악하고자 한다. 셋째, 정비 및 정리 방향은 현황에 나타난 실제상황을 토대로 올바른 방향 및 대응 전략 차원에서 검토하게 된다.
