Forests account for approximately 64% of the total land area of South Korea. The demand for land in South Korea has increased since the 1960s due to the rapid urbanization. Therefore, there is a growing interest in ensuring the validity of laws and regulations related to the conversion from a mountainous district. In this study, it is identified there are several issues in the conversion from a mountainous district and problems in the conversion from a mountainous district permission system.
Moreover, it is studied to deduce a rational improvement plan for the conversion from a mountainous district permission system through evaluating the overseas cases and conducting a survey to mountainous district experts. Germany specified the standards of land proportion for the forest reserve to restrain the conversion from a mountainous district, unlike South Korea. Moreover, Japan prevents a reckless development of the forest land by stipulating a reserved forest, a type of the forest reserve, and forest land development license system, and applying a similar law related to forest development, not individual law.
In the standards of the conversion from a mountainous district license, the topographic deviation and the problems associated with the uniform regulation regarding the detailed regulations on elevation, slope, cut and fill, slope, growing stock, and forest reserve are not considered. To improve the permit standards of the conversion from a mountainous district, the criteria of the mountaintop and foothill should be clarified for elevation, and the regulations considering the mean slope and soil characteristics of a region should be reestablished for the slope.
Similar to the improvement measures of elevation and gradient, a regulatory establishment is required to take into account the terrain characteristics of cut or fill surfaces, such as topography, mother rock, and soil texture, and In inclined surfaces, the vertical height regulations should be supplemented to avoid damaging mountainous areas. Furthermore, it is desirable to propose a preliminary survey method that induces people to make use of the actual growing stock, not the basic forest statistics provided by cities, counties, or townships.
Additionally, the area ratio of conservation areas should be defined according to the regional equity, and policies for ski resorts and golf courses should be strengthened.
