Cities are constructed based on urban planning, which determines two-dimensional land use, and architectural planning, which governs three-dimensional buildings. While it may seem that these two regulatory frameworks are sufficient to constitute a complete city, a regulatory gap exists between them.
For instance, regulations such as those concerning ‘front open spaces’ that provide urban rest areas, or ‘designated building lines’ that preserve the continuity of the streetscapes, fall outside the conventional realms of both architecture and urban planning under current statutes. The system introduced to bridge this gap is the District Unit Plan, pursuant to the National Land Planning and Utilisation Act. Aimed at rationalising land use and improving urban aesthetics, the District Unit Plan establishes building permission requirements for each parcel within a specific district.
It was designed to bridge and facilitate feedback between architectural planning focused on individual buildings and urban planning that addresses broader urban areas. In practice, however, the District Unit Plan tends to be treated merely as a tool for development projects, utilised without due consideration of its specific regulatory substance. Consequently, the original legislative intent has been undermined, with the system often exploited to prioritise development gains. The essence of a District Unit Plan lies in its regulatory content. Therefore, recognising its legal foundation is essential to fully appreciating its multidimensional role and substantive meaning.
Historically, the District Unit Plan was formed by integrating the ‘Detailed Planning’ system of the former Urban Planning Act, which aimed to specify land-use plans such as building use and scale, and the ‘Urban Design’ system of the Building Act, which focused on regulating building exteriors to manage urban landscapes and aesthetics. Viewed from this genealogical perspective, the core of the District Unit Plan consists of three regulatory dimensions: building use, scale, and appearance. Nevertheless, in practice, regulations governing building use and scale are often overutilised for development gains, whereas those related to building appearance remain largely ineffective.
This imbalance stems from the current system’s operational bias—focusing on profitability by exploiting regulations related to use and scale. Reflecting this practical bias, academic circles and other public forums have not sufficiently addressed discussions on building appearance regulations. As a result, such regulations are often poorly drafted, lacking clearly defined legal parameters, and thus rendered nominal, or they are treated as secondary and largely unenforceable. Such marginalisation of building appearance regulation is deeply problematic.
Appearance regulations—including aspects such as building layout, form, and colour—should be recognised as core regulatory components, performing functions as essential as those of use and scale of buildings, and must be effectively enforced. Therefore, in order to correct these practical distortions and realign the District Unit Plan with its original intent, it is imperative to articulate the legal nature and boundaries of appearance regulation.
In particular, such clarification should be grounded in the recognition that appearance regulation derives its legitimacy from constitutional principles and serves multiple regulatory purposes, including the enhancement of urban aesthetics, efficient land use, and building safety. Furthermore, in cases where appearance regulations exceed legal boundaries, judicial remedies should be available through revocation proceedings, with judicial review tailored to the regulations’ specific characteristics.
However, due to their qualitative nature, the detailed provisions of appearance regulations are often embedded in administrative guidelines rather than statutory laws—resulting in structural limitations that undermine legal predictability for regulated parties. Given that the legal nature of such guidelines remains unsettled, varying interpretations may give rise to fundamentally divergent frameworks and outcomes in judicial review. In this regard, both substantive and procedural constraints of appearance regulations should be treated as decisive factor
