The administrative boundaries in South Korea were originally established in 1912 during the Land Survey Project, based on geographical conditions and natural features such as roads, rivers, and ditches.
However, with the implementation of the Land Readjustment Program Act in 1966, land development and housing construction projects led to the straightening of parcel boundaries and administrative boundaries due to artificial construction. Subsequently, with the enforcement of the Rural Modernization Promotion Act in 1970, Land Readjustment Program progressed to increase productivity through land improvement and agricultural mechanization, necessitating the adjustment of administrative boundaries. However, the Land Readjustment Program Act of that era lacked a legal basis for administrative boundary adjustments between villages.
Additionally, while Article 59 of the Enforcement Decree of the Rural Modernization Promotion Act addressed administrative boundary adjustments, it remains unclear whether those implementing farmland improvements consistently applied for changes to village and district boundaries. The administrative boundaries in South Korea, established during the late Joseon dynasty and the Japanese colonial period, have become increasingly misaligned with residents' living areas and municipal jurisdictions due to factors such as urbanization, road and railway construction, and river maintenance. This misalignment has led to challenges in managing administrative districts and inconveniences for residents.
Large-scale development in metropolitan areas has reduced access to administrative services, highlighting the need for rational adjustments to administrative boundaries. Due to the aforementioned needs and causes, this study aims to identify issues related to administrative boundaries and propose improvements. It analyzes the current status and actual conditions of regions that have completed or require administrative boundary adjustments. To this end, the study compared and examined South Korea's Local Autonomy Act, which serves as the basis for administrative district changes, with local autonomy-related laws from Japan, France, and Germany.
The findings reveal deficiencies in the legal basis and clarity regarding legislative form, legislative intent, public opinion, and procedures, despite the fact that administrative boundary changes are governed by the Local Autonomy Act and the Special Act on Local Autonomy, Decentralization, and Balanced Regional Development. Cases of unreasonable administrative boundaries include Seoul's Seodaemun-gu, Seongbuk-gu, and Eunpyeong-gu, as well as Yeonggwang-gun in Jeollanam-do, Gochang-gun in Jeollabuk-do, and Ulju-gun in Ulsan-si.
Additionally, areas where administrative districts have recently changed or need to be changed were selected and analyzed by referring to press releases from the Ministry of the Interior and Safety and internet articles. A survey titled "In-Depth Analysis of Civil Servants' Perceptions to Improve Unreasonable Administrative Boundaries" was conducted among civil servants handling cadastral affairs to develop an improvement plan. This study proposes revisions to the Local Autonomy Act, its Enforcement Decree, and the Act on the Establishment and Management of Spatial Information.
To supplement existing legislation, the proviso to Article 6, Paragraph 1 of the 「Local Autonomy Act」 was initially amended to propose an adjustment of administrative district boundaries for "public facilities" spanning two or more administrative areas. This adjustment would be conducted through cadastral confirmation surveys in accordance with Article 8
