우리나라 지적제도의 사적 고찰 : 미군정전후기를 중심으로

미군정 전후 우리나라 지적제도의 역사적 변천을 고찰했다.

우리나라 지적제도의 역사적 고찰을 통해 근대이전 및 근대이후에 전개된 우리나라 지적제도의 발달과정과 현대지적의 전개과정을 시대별로 재조명하고 해방후 미군정기의 지적에 대한 변화과정을 지적제도의 전반에 대한 조사를 통하여 지적제도가 국가에 미치는 영향을 분석하기위하여 본 연구에서는 서론으로 연구의 목적과 방법을 명시하였고 지적제도에 관한 선행연구 고찰로 지적제도의 이론적 개요와 지적제도의 전반적인 사항을 개괄적으로 서술하고 제도상 문제점을 살펴보았다.

그리고 본론에서는 지적제도의 역사적 고찰을 통하여 시대적 흐름을 비교하고 그 시대별 중점사항을 조사하고 본 연구의 도입단계로 미군정의 구조와 성격을 중심으로 당시의 시대상황 및 조직 구조와 물적 자원 그리고 미군정의 성격에 대하여 조사하여 연구의 방향을 판단한 뒤 본 연구의 본론으로 미 군정기의 지적제도의 운영에 대하여 문헌과 자료를 통하여 농지개혁과 귀속재산 처리, 그리고 미군정하의 지적업무 전반에 대하여 재무부에서의 지적관리, 지적교육, 지적측량 대하여 조사하고 또한 연구의 목적달성을 위하여 해방이후 북한의 지적제도에 대하여 간략하게 토지개혁에 의한 토지대장 정리, 지적사무수수료 개정, 지적업무 전담부서 설치, 지적공부에 의한 대지세 대장 작성, 최초의 지적관련 규정 발표, 지정측량사제도 도입, 지적측량 교육기관 설치, 남한지역 토지개혁법령 발표순으로 해방이후 지적제도의 흐름을 분석하여 제도적, 장치적, 법적으로 철저한 사전 준비없이 지적제도를 운영하거나 사회 혼란속에서 지적제도의 결정은 심각한 문제를 야기시킴으로 정치적 상황과 시대적 상황이 국가의 정책결정과 맞물려 지적제도가 정착되어야 하며 미 군정기 지적제도는 일제의 침략적 지적제도의 연장선 상에서 전개되어 농민 및 사회약층의 계급화가 더욱 가중되었으며 지배계층의 지주제 부활의 결과를 초래하였고 해방이후 미군정전후기에 나타난 사회적 갈등과 민중의 고통은 토지제도 즉 지적제도의 조기 정착에 실패한 미군정과 지배계급의 미홉한 대처에서 기인한바 현재 지적제도의 재창설을 위하여 진행중인 지적법의 개정과 앞으로 추진해야할 지적재조사법 혹은 지적불부합지특별조치법등의 재정과 실현에 사전준비조사 및 계획을 완벽하게 수립하여야 한다.

이에 모든 지적인이 지적제도를 올바로 정착시키기 위해 심혈을 기울여야 할 것으로 사료된다. This study examines the development of the Korean cadastral system to analyse the influence of the Korean cadastral system on the Koreans. In detail, In this study, I investigate the historical process of the development of the Korean cadastral system before and after the Liberation of Korea including the period American military administration. In the introduction of this paper, I present the object and method of this study, give an outline of the theory and the affairs of the cadastral system in general, and its problems to help the basic understanding of it before making up to the main subject.

To proceed to the main issue, I make a comparative study of the currents and main points of the Korean cadastral system according to the period. First, the structure and character of American military administration is principally focused on. To be more specific, the historical conditions of those days, the organizational structure, the material resources, and the character of American military administration are investigated to determine the direction of this study. Then, to see how the cadastral system under American military administration was operated, the farmland reform and the disposal of the government-vested properties are examined by documents and materials.

In addition, the cadastral administration, the cadastral education, and the cadastral survey by the Ministry of Finance are examined to see the general management of the cadastral affairs under American military administration.

Following that, to attain the purpose of this study, a few aspects of the cadastral system of North Korea after the Liberation of Korea, such as the adjustment of a land-book by land reform, the revised fee of cadastral work, the place of the department exclusively responsible for cadastral, the keeping of land tax-book, the publication of the first cadastral regulation system, the introduction of the cadastral surveyor, the establishment of the institution for the cadastral survey education, are examined in brief.

Then, the currents of the cadastral system after the Liberation is analyzed by examining the laws and the ordinances of land reform in the order of their publication, and the influence of this policy on people is looked into. To develop the cadastral system of Korea, we should establish it so that the political situation, the conditions of the times and the determination of the policy can be harmonized. For, some serious problems can be brought about if the cadastral system is operated without complete preparation for the political, legal, and systemaic areas.

And The cadastral system under American military administration was operated by prolonging the aggressive cadastral system of Japanese Imperialism, so that peasants and weaker social stratums were formed as lower social classes, and consequently the ruling classes were revived as the landowning classes. Social conflicts and people's trouble after the Liberation, before and after American military administration resulted from American military administration and ruling classes, who failed to establish land system or cadastral system, poorly toping with the situation.

So We need complete preparation for the preliminary survey and plan in revising the cadastral law whose revision is now under way to reestablish the cadastral system, and in enacting and realizing the law of cadastral re-survey or the special law of the land contradictory to a land register. In view of the results so far examined, I think that all the people who are engaged In cadastral work should make every effort to establish the cadastral correctly.
