지적분야에서의 한국형 ADR제도 모형개발에 관한 연구

지적분야 분쟁의 실태를 분석하고 한국형 ADR 모형을 제시했다.

본 연구의 목적은 지적공부에 관련된 판례를 중심으로 우리나라 지적분쟁의 실태를 조사ㆍ분석하고, 이를 토대로 지적분야에서의 한국형 ADR제도 모형개발을 제시하는 것이었다. 이상과 같은 연구목적을 효율적으로 달성하기 위해 연구범위를 시간적으로는 1970년부터 1999년 6월까지로 하였고, 공간적으로는 우리나라를 대상으로 하였으며, 내용적으로는 지적분야에서의 한국형 ADR제도 모형개발을 제시하는 것으로 한정하였다. 본 연구에서 사용된 연구방법으로 접근방법은 법률적 접근방법과 행정적 접근방법을 병행하였고, 조사방법은 문헌조사법을 사용하였으며, 분석방법은 기술적 분석법(記述的 分析法)을 사용하였다. 연구 결과, 한국형 ADR제도 모형을 개발하기 위해 첫째, 한국형 ADR제도의 체계설정 둘째, 중재기관의 명칭 및 목적설정 셋째, 지적분쟁해결센터의 분쟁해결 절차 넷째, 지적분쟁해결 관련 법령제정 및 개정 등으로 제시하였다. The purpose of this study is to analyze cadastral disputes laying stress on the law precedents relative to cadastre and then to present a Korean ADR system model.

To accomplish the purpose of the study efficiently, the study is focused on the cases from 1970 to 1999 June in Korea terms of time and space. Contents is also concentrated on giving opinion to develop Korean ADR system model in cadastral field. Both legal and administrative approaches were used for study methodology while technical analysis was applied as the analysis method. As a result of the study, the ways to develop Korean ADR system are as follows First, Set up the Korean ADR system structure Second, Decide the title and purposes of arbitration department Third, Arrange the work process of department of arbitration Fourth, Establish and amend the arbitration law of cadastral disputes.
