주요어 : 재건축부담금, 개발부담금, 주택재건축조합, 개발부담금의 우선징수권, 특별부담금 학번 : 93275-525 Based on a comparative review of the contents of the Development Profit Recovery Act and the Reconstruction Excess Profit Recovery Act, as well as the similarities and differences between ‘reconstruction charges’ and ‘development charges’, it can be seen that the reconstruction charges are also a type of development charges. Therefore, it is inconsistent for the Constitutional Court to view the development charges as ‘substantial tax’ and the reconstruction charges as a ‘charges’, and the development charges should also be viewed as special charges.
In addition, after reviewing the Constitutional Court's decision on the reconstruction charges, it is judged that, in relation to the principle of proportionality, the legitimacy of the legislative purpose and the appropriateness of the means of the reconstruction charges can be recognized, but the minimization of infringement and the balance of legal interests have not been achieved.
In other words, (1) in calculating the excess reconstruction profit, the calculation of the ‘starting price’ and ‘ending price’ of the housing unit in the cooperative is based on the published price, while the housing unit price in the general sale is based on the actual sales price, which may cause the excess reconstruction profit to be overestimated, and (2) the cumulative and overlapping imposition of taxes such as capital gains taxeses may result in the confiscation of most of the excess reconstruction profit, (3) there is no legislative consideration for ‘single-family homeowners’ or ‘long-term homeowners for residential purposes’ and so-called secondary buyers, and ④ considering that there is no complementary regulation such as a procedure for refunding the reconstruction charges corresponding to the decrease in the value of the house, the high rate of reconstruction charges system violates the principle of minimization of infringement and the principle of balance of legal interests, which may violate the property rights of the people.
The Constitutional Court concluded that housing reconstruction projects and housing redevelopment projects cannot be considered as a comparison group with constitutional significance due to differences in the Urban and Residential Environment Maintenance Act, but both housing reconstruction projects and housing redevelopment projects are urban maintenance projects subject to the Urban and Residential Environment Maintenance Act, so they are meaningful as a comparison group.
Therefore, the Constitutional Court should have conducted an empirical review of whether imposing a higher rate of reconstruction charges only on housing reconstruction associations would result in a loss of equity compared to housing redevelopment projects that do not impose a development charges or local housing association projects that pay a development charges on 20% of development profits.
Finally, after reviewing the Constitutional Court's decision regarding the priority collection right of the development charges, we concluded that although the development charges is not publicly disclosed, unlike taxes, it is likely to cause property damage to third parties, such as mortgagees and housing tenants, by recognizing the priority collection right of all properties of the payer.
The Constitutional Court's decision should be respected for the sake of legal stability, but legislative complements are needed, such as establishing an institutional complementary device similar to the payment certificate or unpaid national tax list system in the National Tax Collection Act, such as taxes, or recognizing the right of priority collection only for land provided for development projects or apartments subject to reconstruction, so that a function similar to disclosure can be fulfilled at a minimum.
