土地登錄情報의 效率的 運用을 위한 法制의 改善에 관한 硏究

토지등록정보의 효율적 운용을 위한 법제 개선 방안을 연구했다.

Land Registration Information(LRI) is regarded as land information in a narrow sense. LRI is composed of cadastral information and real estate registration information, which form the basis of the national administration and confirmation of the property. Thus it occupies a large part of the whole information activities relating to land. Although it is of practical use, LRI does not form a complete system. In addition, due to a dual systemic structure, land registration business in Korea is not only inconvenient but also complicated. This study both examines and offers solutions for controversial issues.

Consequently, the object of this study is to suggest an improvement in legislation for the effective application of the LRI. In this study, the main terms are defined as follows: ① LRI, in this study, means "gathering of the data to be surveyed for a piece of land and registering it publicly." More specifically, public registry or its contents. ② Legislation of the LRI implies a cadastre and real estate registration in the legal and systemic aspect. ③ An effective application in this study premises that LRI meets the needs of the laws related to the national administration information.

This study depends on leading theses and references to land registration and compares legislation of the LRI with national administration information laws. In addition, it takes advantage of an Internet legal service site(www.moleg.go.kr/). This study proposes the following plan: above all, LRI must raise its level of accuracy. It must also become three-dimensional and it must come up to a fixed standard. After going through the necessary formalities, LRI is being gradually integrated and completed and can be established as the foundation of the Land Information system.

For the reasons stated above, the government needs to improve various laws and regulations in such a way to meet the realistic needs of LRI application. While the legislation of the LRI does not ignore the principle of equity. It must maintain democracy and guarantee an individual's privacy.
