Despite the fact that “land” is absolutely essential for economic activities and stable housing life for the survival of mankinds, it has been the main source of tensions for centuries and decades between states and individuals due to its inelastic demands. In South Korea, given the small size of the land area and the lack of available land, land-related issues have been in the best interest of the people regardless of the era they lived in, not to mention that these issues are ongoing matters.
Especially since the 60’s, as the country’s economic structure began to move away from the traditional agriculture to industrial and urban society, the purpose of land led to a skewed social phenomenon: a means to generate wealth rather than production and housing. Land transaction permit system was established in order to correct the bad practices in land markets and also encourage sound land purchases. However, the reverse side of this system is that there are excessive regulations of the property rights of individuals due to the state power.
Therefore, we will extensively take a look at individual property rights guaranteed by the constitutions, as well as restrictions on these rights due to the public needs. This paper will suggest various alternatives to land-related issues as I believe it is worthwhile to examine such a system in accordance with the constitutional law. First, the land transaction permit system prohibits any contract before a permission is granted. This leads to an excessive intervention by the state power against the basic rights of individuals. Therefore, it may be worthwhile to allow a reasonable time period so that land transaction contacts can be recognized before a permission is granted.
Second, as the paradigm of life changed drastically in the last few decades, it sometimes becomes unavoidable to sign a lease and live under uncertain circumstances because it is strictly enforced that individuals live at their residence for at least a year upon the acquisition of arable land or the highlands. This policy needs to be improved at all costs. Third, the price request for land purchase is also unrealistic. When requesting for purchase of a disapproved land transaction, the regulations may or may not allow buyers to purchase the land depending on their budget situation.
Also, the price for land purchase needs to be complied in accordance with the public compensation law in order to overcome the difference between the actual price and official price In spite of these issues above, the land transaction permit system has not resulted in consistent policies due to the enhancement and easing of its regulations since it was legislated in the late 70s and first enforced in 1985. Moreover, only 0.2% of the land transaction permit are has been maintained after many attempts to abolish the system in recent times as the recession has affected the real estate market since 2008.
It is reasonable to conclude that this permit system should be abolished as we assess the purpose, practicality, and legality, compared to when the system was first introduced.
