The purpose of this study was to review the relevant codes and conditions about reconstruction, redevelopment and new town projects in Seoul and thereupon, compare them from policy perspective and thereby, address the problems and find their solutions. The primary urban policies of the metropolitan city Seoul are reconstruction, redevelopment and new town projects.
The codes regulating them are ''Law on Planning and Using of the National Land', 'Building Law', 'Housing Law', 'Urban and Living Environmental Restructuring Law', 'Special Law for Promotion of Urban Restructuring' (so-called new town project code), 'Housing Ordinance of Seoul', 'Urban and Living Environmental Restructuring Ordinance', etc. The primary urban policies designed according to such laws and ordinances are basic urban planning, general housing planning, planning for new town zones and balanced regional development zones, basic plan for urban and living environmental restructuring, etc.
This study reviewed such relevant laws and codes, conditions of apartment reconstruction and redevelopment projects and new town projects and other development cases and thereupon, analyzed the problems to suggest their solutions. The problems of reconstruction, redevelopment and new town projects are as follows;First, the institutional problems of reconstruction projects are lack of public interests, poor linkage with relevant plans, lack of optimal criteria and principles.
The operational problems of reconstruction projects are widening gap between regions, speculations in houses and apartments, discord between public interest and reconstruction cooperatives, waste of resources due to reckless applications for safety checkup, and so on.Second, the problems of redevelopment projects are high-density development without regard to regional conditions, shortage of public facilities, and collapse of local communities.Third, the problems of living environmental restructuring projects are shortage of public fund, high-density development taking advantage of the special provisions of Building Law, disregard of lower-income people''s stable housing life and so on.The above problems may be reduced to decrease of detached houses, increase of apartments, uniform housing styles and poor urban landscape.
Thus, for the new town projects, it is necessary to expand the public investments in such public facilities as road and traffic facilities, basic living service facilities and park and green zones. If apartment buildings should be reconstructed with residents'' consent, the urban space structure would be likely to be distorted. Therefore, the reconstruction projects should be controlled by Urban Redevelopment Law or a new Reconstruction Law whereby the reconstructed areas should be zoned to be subject to legal extended floor ratio. In addition, an legal mechanism should be arranged to strike a harmony among social equity, economic efficiency and environmental friendliness.
On the other hand, it is deemed necessary to grant some tax incentives and expand financial supports to redevelopment projects, while diversifying their methods, adopting flexible methods, ensuring the social equity and enhancing the efficiency of redevelopment. Currently, the area and planning of the redevelopment projects are determined regardless of citizens'' opinions, so the special law should be revised to reflect citizens'' opinions in such decisions.
