Abstract In order to achieve a fair, efficient, rapid and predictable exercise of state power, it is necessary to prepare for the emergence of a "government for the people, by AI, for the people," which has jumped from a "government for the people, by the people, for the people" by accepting advanced science and technology and reflecting the changed social image, so it is necessary to review the active use of artificial intelligence within the framework of the rule of law administration, check administrative law, and improve legislation.
Policy judgment and normative considerations will be needed as to whether the public and private sectors should be at the same level in preparing a legislative safety net to prevent the emergence of a market economy monster using artificial intelligence Article 20 of the Framework Act on Administration has a target limitation that applies only to the exercise or refusal of public power and other similar administrative actions as administrative dispositions, i.e., law enforcement conducted by the administrative agency on specific facts.
If the provisions of the Framework Act on Administration and the provisions of the Electronic Government Act are connected and interpreted, the provisions of Article 20 of the Framework Act on Administration are unclear and there is considerable room for interpretation. In administrative practice, the role of Article 20 of the Framework Act on Administration will be very insignificant, and in a practical sense, the normative control function of Article 20 of the Framework Act on Administration may hardly work.
The use of artificial intelligence in the land construction field will only be examined in the form of individual dispositions and plans, such as various building permits and land transaction reports, which are judged to be administrative dispositions in the land construction field, but only confirm that the existing administrative law has already placed limits on the use of artificial intelligence through the basic administrative law, or point out the problems of the legislation of the basic administrative law in hermeneutically. The commonly mentioned advantage of artificial intelligence is the ability to collect, process, and analyze data that exceeds human limits.
The advantage of such artificial intelligence is that it is highly likely to be utilized in the planning field that pursues the efficient use of current resources based on predictions for the future. As a device to prevent excessive trust and dependence on artificial intelligence, it is also possible to consider maintaining and operating the committee system under the current law, using artificial intelligence as a role to support policymakers by collecting, organizing, and analyzing basic data, and setting up cross-review procedures for the review proposal proposed by the artificial intelligence system.
The democratic legitimacy of various planning is not determined by the involvement of artificial intelligence or the direct decision of the head of an administrative agency, but is secured in the process of democratic administrative control, such as holding public hearings or listening to opinions.
