不動産仲介業法의 改善補完에 관한 硏究 : 現行 不動産仲介業法令을 中心으로

현행 부동산중개업법령의 문제점과 개선방안을 검토했다.

This paper is written in order to study the problems the act of real estate brokerage has now in Korea and the way to fix and improve it. First, from first text of the act of real estate brokerage the problem is founded. Because the act of real estate brokerage is the special act not common law, the purpose of the act of real estate brokerage should be to establish the basic regulation of real estate brokerage. but at the 1st text, the purpose of the act is prescribed to protect the right of property of the people like that of common law. this shows the act has the problem in the basic sense of the lawmakers.

Second, about certified real estate broker's duty of reporting removal of residence of office the act prescribe to report it after migration but it is more resonable to do before removal of office. for the latter is more useful to protect property of the clients of certified real estate broker. Third, in this paper I mention the problem in the examination for certified real estate broker in Korea. In sudtying this topic I mentioned problem in the subjects of the examination and the process of it and also mentioned the way to improve them. And so on, I studied other problems in the act and which part of the act to improve and fix for the better brokerage of real estate.

So I hope that this paper be useful in finding the problems the act of real estate brokerage has and in the studying the improvement of it.
