Most development project statutes, including the Special Act on Public Housing, adopt a regulatory framework under which, for the purpose of facilitating the smooth implementation of development projects governed by the relevant statute, all development activities within a designated project area are, in principle, restricted from the time the area becomes specified and are permitted only exceptionally upon authorization by the competent administrative authority.
Such restrictions are justified on the grounds that, in the course of development projects deemed to serve the public interest, land within the project area is typically expropriated by the project implementer and existing buildings are demolished to create new spaces and facilities, and that newly undertaken development activities would cause unnecessary social and economic losses.
Recent development statutes, to prevent speculative activities aimed at increasing compensation, tend to proceed by publicly announcing a hearing for opinions regarding the designation of a project area without prior notice, and from the time of such announcement, all development activities within the project area are restricted. Given that there is an explicit statutory basis for such restrictions, there appears to be little disagreement regarding the legitimacy and necessity of limiting new development activities after relevant facts concerning a development project have been publicly announced, for the sake of smooth project implementation and the prevention of socioeconomic losses.
However, it remains questionable whether a uniform restriction on new development activities within the relevant area can be justified solely on the grounds that a development project area has been designated or that a public announcement for hearing opinions has been made. Where a landowner within the project area has been gradually acquiring the public- and private-law status necessary for development, such as permits and approvals, a sudden public announcement of the designation of a development project area may lead to excessively harsh consequences if the continuation of ongoing development activities is denied solely on the basis of such an announcement.
The purpose of the permit system under Article 11(1) of the Special Act on Public Housing is not to impose a comprehensive and uniform prohibition on new development activities within a public housing district, but rather to protect landowners' property rights and harmonize such private property rights with the public interest in the smooth implementation of public housing projects by allowing development activities in certain cases through a concrete balance of public and private interests involved in such activities.
Accordingly, it is not appropriate for administrative authorities to impose blanket and uniform restrictions on the development activities of landowners within the area merely because a public housing district has been designated or a public announcement for hearing opinions has been made. There is a need to establish more detailed and carefully structured standards for granting permits—such as criteria related to balancing public and private interests—to prevent the undue infringement of landowners’ property rights.
