"The Nominal Trust" had been recognized for a long time, but "the Nominal Trust" as a rule will have been prohibited to recognizing because of promulgation of "the Real Act relating to real estates Registration" Under the rule of japanese imperialism, since then "the Nominal Trust" had been recognized, a precedent relating to "the Nominal Trust" considerablely had been built, therefore "the Nominal Trust" had been constituted huge precedent system. But "the Nominal Trust" had been misused of a foul means of speculation, evasion of the law, etc.

Because misuse of "the Nominal Trust" has criticized, the government legistated "The real Name Act relating to real Estates Registration" and the Act as a rule prohibited to recognize "the Nominal Trust". This thesis is the study on "the Nominal Trust and The real name Act relating to real Estates Registration."
