Since the 1970s, the urban population in South Korea has been concentrated owing to industrialization. Consequently, condominium building has become a common type of housing to resolve the housing shortage problem through land development and new town construction. Among the housing types, the share of condominium building reached approximately 78% in 2021, according to the census. Although the number of condominium buildings have rapidly increased and the buildings have aged, legal and institutional measures to improve the residential environment are insufficient.
Reconstruction projects that completely demolish old buildings have side effects such as soaring housing prices caused by speculators, low resettlement rate of original residents, and waste of resources. Therefore, various policies and systems are required to improve aging, structural safety, and building performance. In particular, remodeling projects for condominium building is drawing attention for its positive socioeconomic effects, such as improving the residential environment, efficient use of resources, extending the lifespan of buildings, and high resettlement rates of original residents.
This study proposes the enactment of a special law other than the existing provisions on condominium building remodeling under the Housing Act. Further, it identifies legislative issues and suggests methods to improve them.
The legislative issues include “definition of condominium building remodeling,” “consent to the establishment of housing associations and projects” in the implementation process, “integration of approval systems for project plans and development activities,” and “connection with urban management system.” Regarding remodeling projects aimed at increasing the number of households, this study examines a “safety inspection period” and a “project support system.” The findings of this study are summarized as follows. First, the Housing Act and the Building Act define remodeling differently.
This discrepancy obscures the boundary of a large repair that does not correspond to extension, renovation, or reconstruction owing to repair of major structural parts or change in external shape of a building. Therefore, this study proposes a legislative proposal to redefine the definition. Second, regarding the implementation process, the current system for establishing housing associations and project consent procedures needs to be improved to stimulate remodeling. The current system prevents a project from proceeding because the consent process for establishing associations tends to be slower than the consent process for a project.
Moreover, this study argues that there is no need to distinguish the subject of project or development approval because there is no fundamental difference between the remodeling projects aimed at increasing the number of households and other remodeling projects. Therefore, this study suggests a legislative proposal to integrate the approval systems. Third, a lenient floor area ratio can be applied to remodeling aimed at increasing the number of households, however, in practice it is difficult to be applied without an urban management system. Further, in the case of remodeling to increase the number of stories, safety has emerged as an important issue.
To ensure safety, buildings must undergo safety inspections twice; however, in practice, the timing required for the inspections do not allow it. Thus, this study provides a proposal to address this issue. Fourth, this study offers a legal proposal to secure a practical supporting system including subsidies and loans, so that the system can stimulate remodeling projects for condominium building. It is expected that this study elucidates the issue of aging houses and contributes toward promoting the residential environment of the public and condominium building remodeling.
