지적불부합 해소의 효율적 방안에 관한 연구

지적불부합지 해소를 위한 지적재조사 관련 법령과 대안을 분석했다.

다양한 토지문제를 발생시키는 지적불부합지를 해소하기 위해 지적재조사사업이 2012년 이래로 추진되고 있다. 따라서 본 연구는 지적불부합지 해소를 효율적으로 처리하기 위한 대안을 제시하고자 지적재조사사업에 관련 된 법령을 검토 및 분석하여 보다 합리적이고 경제적인 대안을 제시하고자 한다. 이러한 연구목적을 달성하기 위하여 연구범위는 지적재조사사업에 관련된 법령으로 한정하고, 조사방법은 문헌조사 및 인터넷조사를 통하여 1차 및 2차 자료를 수집하며, 접근방법은 서술적 접근방법과 체제론적 접근방법을 병용한다. 연구결과는 다음과 같은 관점 및 내용에서 도출하고자 하였다. 첫째, 법률규정과 기본계획 현황은 지적재조사사업에 관한 특별법, 공간정보 구축 및 관리에 관한 법률에 규정된 내용 차원에서 검토하게 된다. 둘째, 분석 및 평가는 기본계획에 나타난 재원조달, 세계 측지계변환 및 개별불부합지, 추진조직 차원에서 접근하고, 관련 법률은 지적불부합지 정리규정, 사업지구지정의 지정, 조정금 및 청산금 차원에서 이루어진다. 셋째, 효율적 대안은 재원조달 방법의 개선, 추진조직의 정비, 해소방법의 다양화, 조정금 산정기준 차원에서 검토하게 된다.

The cadastral rehabilitation project has been underway since 2012 to solve the cadastral inconsistency lands that cause various land problems. Therefore, this study aims to propose more reasonable and economical alternatives by reviewing and analyzing laws and regulations related to cadastral rehabilitation projects to propose alternatives to effectively deal with cadastral problems.

In order to achieve the objectives of these research, the scope of the research is restricted to the laws related to the cadastral reinvestigation project and the survey method collects primary and secondary materials through literature survey and internet survey and approaches Uses a narrative approach and a system theory approach in combination. The results of this study are as follows. First, the legal regulations and the status of the basic plan will be reviewed from the level specified in the Act on the Construction and Management of Spatial Information and the Special Act on the Cadastral Rehabilitation Project.

Second, the analysis and evaluation approaches in funding, global geodetic conversion, individual irrigation and promotion organization as shown in the basic plan, and related laws are made in terms of cadastral inconsistency property dispute settlement regulations, designation of business district designation, adjustment and settlement. Third, efficient alternatives will be reviewed in terms of improvement of funding methods, improvement of promotion organization, diversification of settlement methods, and standard of adjustment calculation.
