주거권 보장을 위한 부동산 등기사항증명서 발급 수수료 무료화 방안 연구 - 공신력 부정 구조와 정보접근권의 관점에서

주거권 관점에서 부동산등기정보 발급 수수료 면제 방안을 연구했다.

대한민국의 부동산등기사항증명서는 임차인에게 필수적인 공시정보로서, 임대차 체결 전 위험점검, 임차보증금 보호, 전세사기 예방, 분쟁 시 증거 확보에 중요한 기능을 수행한다. 그럼에도 불구하고 우리나라 등기제도는 등기의 공신력을 부인하면서도 등기정보의 열람 및 발급에 수수료를 부과함으로써, 국민이 거래안전을 확보하기 위하여 사실상 필수적으로 수행해야 하는 확인행위에 경제적 부담을 지우고 있다. 본 연구는 주거권의 관점에서 등기정보 열람·발급 수수료의 면제 또는 준면제의 필요성과 정당성을 검토하고, 보편적 면제, 주거목적 조건부 면제, 취약계층감면 또는 바우처, 열람 무료와 실비기준 발급 병행 등 다양한 제도설계 대안을 비교하여 정책적·입법적 개선방안을 제시한다. 또한 2018년부터 2024년까지의 열람수수료 수입 자료를 토대로 재정적 영향을 분석하고, 대체 재원조달 방안도 함께 모색한다. The real estate registration certificate in Korea is essential public notice information for tenants: it supports pre-lease risk checks, protects security deposits, helps prevent jeonse fraud, and serves as key evidence in disputes.

Yet Korea denies the public reliability of registration while charging fees for viewing and issuing registration information, creating a financial barrier to the “mandatory verification” that citizens must perform to secure transactional safety. From a housing-rights perspective, this study examines the necessity and legitimacy of waiving (or quasi-waiving) issuance fees and compares alternative designs—universal fee waivers, housing-purpose conditional waivers, exemptions/vouchers for vulnerable groups, and free viewing with cost-based issuance—to propose policy and legislative options.

Using 2018–2024 revenue from viewing fees, it also assesses fiscal implications and suggests replacement financing.
