ABSTRACT The Irrationality of the Capital Gain Calculation in the Estate or Gift Tax Submitted by Jong-Hee, Na Major in Management of Business Administration Graduate School of Business Administration University of Incheon From January 1, 2007, actual transaction price has been applied in the calculation of capital gains on taxable assets in real estate transactions. When calculating capital gains from actual transaction price the difference between the prices at the time of transfer and the prices at the time of acquisition as well as other additional expenses are subtracted from this calculation.
However, in the cases where information on actual transaction price at the time of acquisition is not available or cannot be verified because a property was acquired a long time ago calculating capital gains becomes difficult and the capital gain tax calculations may vary depending on how a property is acquired. Especially when a property is inherited or donated and transferred for value, depending on whether or not a tax base had been applied to associated taxes at the time of acquisition and the value of the real estate at the time of registration, the capital gain calculations could be different.
In addition, if the heir or donee had not file a tax base registration concerning taxes, the capital gain is classified as an acquisition through purchase and then a transfer for value and its amount can be much greater than the gain calculated in the cases where the actual transaction price cannot be verified due to various reasons including an error or omission. This is also a problem. This study analyzes different cases for apartments and forests which are both subject to taxation. The apartments are acquired through inheritance and forests through donation.
For both types of acquisitions, the capital gains and taxes levied on the gains in the cases where the heir or donee had filed a tax base registration on the day of inheritance or donation and where they had not are compared.
It is concluded from the case analysis that in the cases where the heir or donee had not fulfilled the tax base registration on the day of inheritance or donation, in other words where tax standard value was recorded as the actual transaction price at the time of acquisition, the capital gain and tax levied on the gain are observed to be much greater than that calculated in the cases where a tax base registration concerning associated taxes based on either a real or evaluated price had been filed.
The capital gain and levied taxes calculations for the same property acquired through inheritance or donation could be hugely different depending on whether or not the heir or donee had fulfilled a tax base registration based on real market price, which result indicates that this tax policy violates the principle of equal taxation as well as putting too much burden on tax payers. On the other hand, if a property was acquired through purchase and then transferred and the capital gain is calculated accordingly, Income Tax Law is applied to such cases where the actual transaction price cannot be verified or confirmed so to substitute a conversion value for the acquisition price.
Therefore, I hope that the amendment of related tax law is made so that the conversion value can be applied as in the case that the real state property was transferred after being acquired by succession and donation without declaring the standard of taxation as well as when it was acquired by transaction.
