To achieve tax justice in its distribution, horizontal and vertical equity have to be secured. In particular, the issue of maintaining equity of real estate assessment for taxation has been a matter of concern and interest for researchers and policymakers worldwide for decades.
An essential prerequisite to ensure rationality in a taxation system that links tax, such as property tax, to the appropriate value of property (hereinafter referred to as market value), is to maintain a balance, but a number of factors of the tax assessment process have been pointed out as actually harming this equity. These factors are the time difference between the transaction date and assessment date; the relative frequency of comparable sales over each price layer; the owner's active opinion statement on errors of recognition about characteristics of properties or not; the extent of the assessor's expertise; and the stance related to politics, administration or other practicalities.
When the assessed value corresponds to the market value, its assessment can be acknowledged to obtain horizontal and vertical equity. Horizontal equity can be achieved when people pay the same amount of tax as the value of the property, while vertical equity can be realized when the ratio of the assessed value to market value (hereinafter referred to as the assessment ratio) is equivalent regardless of the value level of the property. On vertical aspects, the assessment ratio of high-priced property is referred to as 'regressive' when it is lower than the ratio of low-priced property, while when the ratio of high -priced property is higher than low-priced property, it is 'progressive'.
Many previous studies have revealed that tax equity has been frustrated due to the regressive effect of the assessment ratio over the assessed value, which was supposed to be achieved through the progressive taxation of property tax. It can also be understood that plutocrats’ own high-valued houses enjoy certain benefits, when compared to ordinary people with middle- or low-valued houses. In addition, defects in the assessment pattern regarding nonresidential properties have been pointed out, which ignore the market practice of trading land and buildings together instead value land and buildings independently.
However, the improvement plan for the introduction of an official assessment of nonresidential estates is in progress. In this context, this study empirically proved the unequal status of vertical equity and its reasons on the assessed value of houses and nonresidential property as follows. First, GLS linear regression analysis was performed by designing PRD results and the model suggested by IAAO to verify the vertical inequality according to the year of each local autonomous government. Along with this, quantile-regression analysis with 10 ranges pooling yearly data was also carried out by each borough.
The design of the analysis model using instrument variables suggested by Clapp and results were also given. In the wake of the independent analysis regarding houses and nonresidential property, the vertical injustice was confirmed in every area of Seoul and this inequality of single-family houses was further intensified in 2014 compared to 2006. This turned out to be because the inequity of low-valued houses continued to grow. Vertical inequality was also strongly presumed by quantile-regression analysis. In comparison to 2008, this status was increased for nonresidential properties in 2013 and in all years there was a stronger inequity of nonresidential properties than houses.
However, the different results from houses were obtained by quantile-regression analysis because there was no great distinctive range. Second, based on vertical inequity analysis results, the factors determining the equity were presented and the causes were explained. For this purpose, a panel model
