This paper's purpose is the investigation of the practical use of new device as "the use of land fiduciary development system" for the effective use of land. In the content of this paper, I studied the limitations of this system and problems by analyzing the case of land use in Japan and the actual conditions of land problems and the real estate policy of government. The ultimate purposes of land policy are the effective use or preservation of land, equitable distribution of utility or income, and the security of financial income and public facilities.

And the means of accomplishing these purposes are the restrictive development of land, a notification system of standard current price, "the system of taxation", and "direct intervention" like re-development or expropriation, or land re-adjustment work. But the effective achievement is impossible with the only land policy of goverment. In this paper, the intervention of private sector is added to the public side of effective land use and it must be very good system in principle for all. In addition, this system is applied actively in Japan which has similar problems of our country, and if some problems can be solved, this system will be put into practical use in Korea.

We have many restrictive factors in adjustment of legal system, the supply of fiduciary sources, stability of land price, the security of expert workers, actualization of land fiduciary, and the security of profits. But if the government preserves and enforces the public concept of land, and solve the current problems, the prospect for land fiduciary will be very bright. Finally, the introduction and application of land fiduciary must be propelled continuously for national welfare and activities of regional finance.
