초록
Land, in essence, takes on a character of immobility and immutability incapable of reproduction. For the reason of these properties, unplanned and indiscriminating land development brings about the unrestorable state of affairs in relation to land use. The fact is that the gravitation of the population towards big cities due to the past policy giving the highest priority to economic development caused many problems of deteriorating efficient land use as well as land shortage. Government implemented the reinforced policy of restriction on land use as the method of resolving this land use problem. This regulation-centered land use policy impeded the active and realistic use of land.
An attempt was made to investigate the specific problem of regulations on land use and its improvements. As a result, the following findings were obtained: First, the fact is that government's inordinate intervention in land use developed in a direction of scaling down the role of local government. That is, central government's inordinate intervention in the field of land use regulation also can not be an exemption. Central government should now decrease its excessive intervention in land use and present only the basic guideline and standard for land use.
And it should provide technical, financial support for local government to establish the realistic land use plan aimed at attempting to activate the market by devolving much of its authority upon local government. Second, the overlapping of the law and regulation systems of restriction on land use, the resultant conflicting interests arising from the purpose of legislation between related laws and the allocation of authority between government agencies act as the great factor of deteriorating the reasonable use of land.
To resolve this problem, it is necessary to readjust and simplify the overlapping laws providing the designation of the zone/district/area of similar and identical purposes and means for restriction on land use and readjust the unreasonable land use restriction of overlapping contents between laws and regulations by making a comprehensive synthesis of the separate laws related to land use. Third, individual land use restriction laws are providing for the designation of land use in an one-sided way. This causes the problem of the space construction without diversity by making extra-use land use difficult.
Transformation is needed to progress from restriction on land use through this rigid means to the positive attitude of the land use restriction through financing and tax incentives and resident-centered land use restriction attaching importance to their opinions. Fourth, one of the important aspects of the land policy for the years is the proper harmonization of equity and efficiency of land use.
To take equity and efficiency into consideration, it is necessary to make an accurate analysis of the effectiveness of the policy means of land use restriction policy, make proper compensation for people resident in the zone suffering from losses due to land use restriction, and confer an opportunity for proper land use on the development restriction area. An attempt was made to present the following land use activation plan: First, it is necessary to expand urban land properly. Second, it is necessary to make active use of the mountainous district.
For this purpose, it is necessary to deviate from the practice of developing land in a unsystematic way in accordance with individual laws and make a systematic formulation and development of the comprehensive land development plan by linking mountainous districts with the national land and local land development plans. Third, in land development, public land developers should (이후원문누락)
