Foreign investment in Korean real estate can generate positive economic effects, including the inflow of foreign capital, financing for real estate development projects, diversification of investment risks, and improvement in market transparency.
At the same time, it may also cause adverse effects, such as distortions in housing prices in particular regions, regulatory disparities between foreign and domestic purchasers, outflows of speculative capital, and risks to national security. In particular, foreign purchasers may effectively circumvent domestic regulations on the loan-to-value ratio and debt service ratio by obtaining financing from overseas financial institutions. Moreover, the current regulatory system has limitations because it is difficult to verify foreign purchasers’ ownership of overseas housing and the sources of their acquisition funds.
This study examines the current status of foreign investment in Korean real estate and the relevant legal framework, and analyzes its economic and legal effects on the Korean real estate market and citizens’ right to housing. For this purpose, statutes governing foreign ownership of land and housing, statistical data, and previous studies are reviewed. In addition, foreign real estate acquisition regulations in major countries, including Singapore, Australia, Canada, and the United States, are comparatively analyzed. The findings indicate that the inflow of productive foreign capital may contribute to real estate development and the revitalization of capital markets.
However, speculative investment in residential real estate may lead to price increases and gentrification in certain regions and undermine housing stability for domestic residents. Furthermore, foreign acquisition of land near military facilities and nationally important infrastructure should be subject to separate review and control from the perspectives of national and economic security.
Accordingly, this study proposes strengthening the verification of funding sources for foreign real estate acquisitions, introducing a reporting system for overseas housing ownership, expanding the land transaction permission system in areas vulnerable to speculation, establishing a prior review system for acquisitions in national security-related areas, and incorporating the principle of substantive reciprocity into legislation. A balanced regulatory framework should be established to actively attract productive foreign investment while reasonably restricting speculative capital that may threaten citizens’ right to housing and national security.
