This study examines the legal nature and reviewability of the cadastral survey objection system under the Act on the Establishment and Management of Spatial Data, and proposes a structural reconfiguration of the rights-remedy framework based on a reassessment of its disposition character. The Korean Supreme Court has traditionally denied the status of an administrative disposition to entries in the cadastral record, viewing them merely as administrative measures for convenience and evidentiary purposes rather than acts that directly alter substantive rights.
This position is grounded in a functional distinction between registration (as a method of public notice of real rights) and cadastral records (as factual public management). However, cadastral survey results in practice function as de facto standards in boundary disputes, serve as foundational data for various administrative decisions —such as building permits, development approvals, and compensation assessments—and substantially define the practical scope of property rights. From a substantive perspective, they cannot be reduced to mere factual acts devoid of legal effect.
In particular, the decision of the Central Cadastral Committee in the objection procedure operates as a final determination within a rights-relief mechanism. Despite its practical significance, its legal character remains unclear, resulting in structural inconsistencies between administrative litigation and civil boundary- confirmation actions, as well as uncertainty regarding judicial review. This ambiguity undermines legal predictability and the effective protection of property rights.
This article argues that the decision of the Central Cadastral Committee should be recognized as an independently reviewable administrative disposition, or at minimum be explicitly deemed equivalent to an adjudication under the Administrative Appeals Act. It further proposes legislative reforms, including the clarification of standing requirements, restrictions on repetitive petitions, and the introduction of an ADR-based conciliation mechanism within the cadastral review framework.
Ultimately, the restructuring of the cadastral survey objection system is not merely a procedural adjustment but a structural administrative law task aimed at strengthening substantive protection of property rights. Such reform aligns with the modern administrative law paradigm that prioritizes effective rights protection over formalistic categorizations
