Abstract The Policy Effect of Capital Gain Tax in Korea Wan Yong Kim Major in Tax Policy Graduate School of Science in Taxation The University of Seoul Aside from the fundamental functions of taxes for capital gains, taxes for transfer income converts part of the development profits or unearned income from speculations in order to perform its role as a real estate policy tool such as redistribution of income or stability of real estate prices, together with reduction of capital gain taxes to function as a policy tax for purposes of revitalizing the construction economy, supporting corporate restructuring, etc.
Rather than being more steadfast to the taxing principles of capital gains, Korea's capital gain tax is more of a policy tool to prevent speculation in real estate or to jump start the economy. This is clearly evident when examining the process of the economic situation or political tendencies of the government during the administration of different parties. Therefore, in this study, the transitions throughout the capital gain tax in Korea will be examined in detail, and the goal is in finding the problems as a policy tax and for ways to improve upon such problems.
In addition, a simple statistic model will be used to see just how effective capital gain tax was in terms of tax policies according to the corresponding economic situation. Based on this, the problems were deduced and improvement plans were searched for. Major contents of it are as follows. First, policy directions of strengthening or softening capital gain tax policies were assessed to not have statistic significance in the increase of land prices, and changed through overall economic factors such as economic growth rates.
Therefore, there are limitations in stabilizing the real estate market through capital gain tax, and in reality, its use is stopped short only at encouraging or discouraging transactions. In other words, rather than its original function as an income tax, softening or strengthening capital gain taxes for policy objectives cannot be a fundamental solution for stabilizing the real estate market, and, therefore, economic stabilization must be pursued through autonomic mediation of the market economy by creating a balance between supply and demand in the real estate market.
Moreover, there is a need to create a strong market structure that can withstand a considerable amount of outside economic shock. Second, in the case of targets for capital gain taxes, because capital gain taxes are imposed on only certain assets, while not taxing similar gains from transfers for assets that are not subject to taxation, the taxes on assets with the same value differ, and therefore causes problems that violate tax equality. Therefore, certain movable assets that are currently excluded from taxation must also be included in capital gain taxation.
Third, because the current tax structure for capital gain tax is excessively high, there is potential risk of violating the property rights of tax payers, and there are also a great deal of other problems in terms of equality with other income. Also, setting the tax rate as high as it currently is will lead to the rise of real estate prices due to the transfer of taxes, and therefore is not suitable for the policy goals. Hence, the same basic tax rate with other income should be applied through gradual reforms of the tax structure.
Fourth, the tax exemption and reduction policy related to capital gain tax in Korea is not regulated by the Income Tax Act, but instead by the Restriction of Special Taxation Act, and thus has legislative issues. Therefore, by prescribing capital gain tax reduction provisions in the Income Tax Act, efforts should be made to systematically achieve policy goals in order to realize tax equality throughout the nation's economy.
Despite the fact that this study focused on analyzing the effective of tax policies through the transitional course of capital gain tax, there was difficulty in converting the capital gain tax policies into mathematical data, and also difficulty due to its complex changes and tax structures. Consequently, in-depth statistical analysis was not made, and for this, additional research is necessary.
