This study periodizes six decades of Korea’s urban planning and redevelopment legislation by reading it against one hundred years of Japanese urban planning legislation (1919-2019), and analyzes the resulting time lag together with the compressed character of Korean legal development. Three criteria-normative purpose, core planning instruments, and the allocation of roles between public and private actors-are operationally defined, and a three-part test for functional correspondence is specified in advance: isomorphism of purpose, equivalence of instruments, and parity of systemic status.
Only pairs satisfying all three enter the main series, while near-matches are reported separately as a control set. The framework is applied identically to both jurisdictions and then deepened through detailed comparison of four institutional fields: zoning, redevelopment instruments, regeneration governance, and shrinkage management. Functionalist comparative law is combined with legal-transplant and path-dependence theory. Japan’s century divides sequentially into formation (1919-), growth (1955-), transition (1990-) and shrinkage (2010-).
Korea passed through formation (1962-), growth-development (1972-) and transition (1998-) before entering, after 2020, a compressed-overlapping period in which development, regeneration and shrinkage coexist. Across the three confirmed paradigm shifts the catch-up interval narrowed from 43 to 34 to 11 years; for shrinkage management, however, Korea has introduced no spatial-planning counterpart to Japan’s Location Normalization Plan (2014), leaving the lag unresolved and widening. This discontinuity is offered not as established causation but as a testable hypothesis: overlapping developmental stages, not legislative incapacity, obstruct a single nationwide paradigm.
The study accordingly proposes a multi-track legal system with statutory eligibility criteria, a Korean location normalization plan grounded in a component-by-component assessment of receivability, a functional division of labour among redevelopment, regeneration and mixed-use development statutes, and a phased legislative roadmap.
