Under the National Land Planning and Utilization Act, the regulatory content of a district-unit plan is fixed through four instruments: the Act, its Enforcement Decree, the District-Unit Plan Guidelines issued as a directive of the Ministry of Land, Infrastructure and Transport, and the district unit plan criteria drawn up by local governments. Of these, the Guidelines matter most. They give concrete shape to the abstract content prescribed by statute and, in doing so, settle what the regulation actually is. That function has gone unrecognized. On the legal nature of the Guidelines little has been said beyond the observation that they are, in form, administrative rules.
Burdensome regulations of uncertain legal basis, such as joint development and open space within a building site, surface in the Guidelines. The structure and limits of the delegation behind them, however, have not been examined with any care. This study traces the delegation structure that produces the regulatory content of district-unit plans, from statute down to administrative rule, and asks what the Guidelines legally are and how far the delegation to them reaches. That content has accumulated as technical needs arose, with no attention to system.
In the resulting disorder, regulations that substantially restrict the rights and obligations of their addressees have surfaced for the first time in the Guidelines, an administrative rule, with no authorizing basis behind them. Statutes and subordinate legislation do delegate certain matters to the Guidelines. But the delegation reaches no further than listing considerations relevant to part of the regulation, which falls short of the individual and concrete authorization that would make the Guidelines an administrative rule supplementing statutes.
The Guidelines nonetheless bind the officials who formulate the plan, and residents exercising the right to propose a plan treat them as the operative standard. In practice they carry force close to external binding force. The criteria set by local governments rest on the Guidelines, an administrative rule, and yet generate regulatory content of the highest density of all. Regulation of this weight is thus given its substance by an instrument that is, in form, nothing more than an internal standard of the administration. That is hard to justify under the principle of statutory reservation.
Regulations that substantially affect the rights and obligations of their addressees need a clear basis in statute, and the criteria set by local governments need an authorizing basis in statutes and subordinate legislation rather than in the Guidelines.
