The aim of this study was to research and analyze the registration situation of cadastral surveying agency and the operational conditions and to suggest a solution on the arisenproblems in operation.
To satisfy the study purpose effectively, the voluntary settings are as followings: (i) The scope of study subject is limited to the cadastral surveying agency. (ii) The scope of time is from 1st Jan in 2004 when registration of cadastral surveying affair was allowed legally and a new agency system was introduced after the constitutional court's decision of disagreement had been made on 30th May in 2002 up to 31th march in 2007. (iii) The scope of space is restricted within the cadastral surveying agency registered by the cadastral law.
(iv) The scope of contents is limitedto knowing the operational problem of the cadastral surveying agency and to suggesting a solution to that matter after having research and analysis on the operational situation of the cadastral surveying agency such as registration matter, members registered, orders received etc. To satisfythe study purpose, used methods are as followings: (i) A method of both historic and legal approach was used. (ii) Amethod of documentary reference and internet search and a case method were used to acquire the dada needed.
The result is that: In terms of the operational problem, (i) The current cadastral law doesn't have any regulations to demonstrate and test the cadastral surveying agency's ability to perform the works. and it also allows any surveying agency to register without further restrictions if his terms and conditions are consistent with the standard and criteriastipulated by the current cadastral law. (ii) There's institutional irrationality triggered by separation of registration and supervision.
the surveying agency is anywhere able to continue his work regardless of districts, due to this institutional operation system, the offices concerned are hardly able to grasp the situation, let alone supervision over the performances the surveying agencies have done on the district (iii) There's no sort of contract system for confirmation of the cadastral surveying. So the client is bound to sending an order to choose a suitable performer on a self-selection basis, which is considered not to properly evaluate the capacity of the surveying agency because of possibility of the client's subjective intervention, resulting in a contract that the client alone leads.
To resolve these problems, we suggest that: (i) The terms and conditions for registration stipulated by the cadastral law should be enforced to a certain extent. (ii) Standard and criteria to objectively evaluate the capacity of the surveying agency are to be made. (iii) Standards and criteria like examples and instructions of the local autonomous entity for theselection of qualified surveying agency which has enough technology and credits and experience are to be made. (iv) An institutional device is needed to enhance and evaluate the capacity and qualification of the surveying agency by letting agency members have an educational training.
