부동산 경매에서 임차인의 법적 지위와 권리 보호를 검토했다.
초록
This study is how a tenant has the status and how the tenant's right plays a role in the real estate auction. It is also considering the problems and the remedy depending on lawful and institutional positive analysis on 1) the status of auction tenant 2) the status of housing tenant 3) the status of business building tenant. The first chapter presented the purpose and scope and method of this study. The second chapter defined the tenant in the law theory by considering theoretically the status of tenant and looked into the auction procedure and tenant, the housing rent and tenant, business building rent and tenant.
The third chapter surveyed the tenant's status on attachment, conversion, allotment, evacuation in auction procedure by lawful and institutional analysis positively on tenant's lawful status. This chapter showed the establishment background, development level and application scope on housing lease protection law. It also surveyed opposing power, opposing power ownership, and the contents of opposing power as tenant's lawful status as well as the prior repayment made up of the housing delivery, resident registration moving in and the fixed date.
And then it showed the establishment background, and application scope of business lease protection law, opposing power, opposing power ownership, contents, prior repayment, the small sum deposit, the term and renewal on rent contract, rent increase and decrease bill right etc. The fourth chapter considered the problem and development plan on tenant's lawful status. The fifth chapter surveyed the result of the consideration on three aspects of the tenant's status.
