지적법 변천에 관한 통시적 연구

지적 관련 법률의 제정 배경과 변천 과정을 통시적으로 분석했다.

This study is not directly deal with problems of legislative process and contents about the Act on Consolidation of Land Survey and Hydrographical Operation and Cadastre, which is nearing enforcement. The purpose of this study is to minimize problems in implementation of its. The study aims to diachronic analyse the legislative reason and the legislative process for Cadastral Act, Land Survey Act, Hydrographical Operational Act, Cadastral-Related Laws in Korea. It purposes both to review the establishment process of Cadastral Consolidation Act and to indicate its problems.

It is important to minimize of social confusion and to promote the cadastral resurvey and to adjust of survey market and to amend of unreasonable provisions and etc. all through enforcing period. Unless the serious problems are solved, we would separate or restore of its as a long-term alternative. 본 논문은 시행을 앞두고 있는 「측량·수로조사 및 지적에 관한 법률」의 입법상 문제점, 법률상 문제점을 직접 다루고 있지 않다. 지적통합법이 정상적으로 운영될 수 있도록 문제를 최소화하고, 장기적으로 무리한 통합 때문에 문제가 된다면 지적통합법의 재분리 또는 환원을 주장할 수 있는 근거를 제시하는 데 목적을 두고 있다. 이를 위해 지적법, 측량법, 수로업무법, 지적관련 토지공법, 지적통합법에 대하여 제정이유, 변천과정, 정부와 국회의 입법과정을 중심으로 통시적 고찰을 하고 있다. 지적통합법의 시행에 있어서 사회적 혼란의 최소화, 지적재조사사업의 지속적 추진, 측량시장의 적극적 조정, 불합리한 규정의 조속한 정비, 통합법 이후 후속조치의 공개적 논의, 지적 분야 과제의 지속적 추진이 중요하다.

무리한 통합으로 인해 장기적으로 해결할 수 없는 문제가 산적하거나 남북한 통일이 임박할 경우에는 지적통합법에서 재분리 또는 환원되어야 함을 강조하고 있다.
