Abstract This study examines the smart city not merely as a subject of technological innovation or industrial promotion, but as a public-law-based urban governance system in which urban infrastructure, public services, data utilization, citizen participation, and land-use order are closely interconnected.
Although the current legal framework for smart cities provides an institutional basis for solving urban problems and improving service efficiency, a technology-centered approach may give rise to significant legal and social issues, including infringement of personal information, the digital divide, opacity in algorithmic administration, dependence on private platforms, restrictions on property rights, and compensation for losses. From this perspective, this study analyzes the current status and limitations of smart city legislation through the lens of human-centered digital governance and reconstructs the meaning of publicness and citizen participation under public land law.
The study finds that the legitimacy of smart cities should not be secured merely by technological advancement, but by the protection of fundamental rights, transparent control over data and algorithms, digital inclusion, participatory urban planning, and a balanced adjustment between publicness and private property rights. In particular, smart city planning should be closely linked to urban planning under land-use law, while data collection and AI-based administration should be premised on explainability, objection procedures, and accountability.
Moreover, where the installation of smart city infrastructure or regulatory sandbox projects imposes a special sacrifice on certain residents, effective remedial measures, including compensation for losses and the possibility of state liability, should be established.
Accordingly, I proposes several legal and institutional improvements for realizing a human-centered smart city: the statutory clarification of basic principles for human-centered smart cities, the strengthening of participatory urban planning systems, the reform of legal frameworks to secure digital publicness, the establishment of accountability and control mechanisms for AI-based administration, the construction of sustainable smart city governance, and the development of concrete mechanisms for compensation.
Ultimately, smart cities should move beyond a technology-centered model of urban management and evolve into a human-centered urban order grounded in publicness, participation, accountability, and sustainability.
