In the past in response to the extensive devastation of Korean forest, Korean forestry policies have set its goal primarily of afforestation and absolute protectionism for the already existing woods.
In present days, however, considering the conservational movements of the countries with natural resources as well as the international environmental control movements such as the UNFCCC (United Nations Framework Climate Change Convention,) the sustainable management of forestry is not just an idealistic agenda solely reserved to the vanguard nations of forestry but also a political agenda for any nations with forest. The main goal of this study is to examine the system of law pertaining to the forest, the parts of the Special Criminal Law pertaining to the forest and the combination and amendment of the law concerning forest to support the UNFCCC.
First of all, in comparison to those of other developed countries of forestry, the Korean policy, law, and system of forestry do not support to full extent the route of public participation. Moreover, when it comes to effectively utilizing and applying the various articles of the Forest Law, specifically the ones pertaining to the management and the utilization of the forest, Korea should develop a realistic system of national standard index that fits the domestic needs and conditions through combining and amending these articles. Secondly, in case of violation of the Special Criminal Law perstaining to the forest, aggravated punishment follows.
As a correspondence to such current status, the applicative area of the General Law, not of the Special Law, should be expanded. The combination and the amendment of the Forest law is followed by another very significant agenda; the restoration of the damaged forest and ecology by means of afforestation. Technically as a precaution of forest damages, it is necessary to promote the “special control” and prevention projects for general volunteers. Lastly, paying close attention to the combination and amendment of the law concerning forest to support the UNFCCC, the government and the related institutions of forestry should push ahead several projects.
They should stipulate the carbon-absorbing function of the forest as an emblem of a natural absorber. Also, they should establish a system of special law that acknowledges the International Cooperation and Development Transactions of Forestry as the Clean Development Mechanism Transaction. In order to manage the domestic forest in Korea and to complement the subsidization system, they should secure and sustain the process of afforestation and its expansion, consolidation, and amendment.
Increasing the number of carbon absorbing sources through the restoration of the woods in marginal farms, as well as intensifying the supervising process of the exclusive forest areas, are never less important agenda. The government and the related institutions should systematically, technologically, and financially support the enterprises in their carrying out the forest absorbing source policies.
To continuously sustain the pro-environmental policies, Korean government and other related institutions should not only conduct basic statistical research about the precise amount of the emission and the absorption of carbon in Korea, but also pay close attention to set up the relevant systematic supporting devices.
