土地利用規制改革을 위한 關聯法制의 改編方案에 관한 硏究

토지이용규제 개혁을 위한 관련 법제와 용도지역제의 개편 방안을 제안한다.

Recognizing such shortcomings as above, this syudy suggests that the significant improvement of the zoning system could be achieved through the systematic integration and reduction of the current land-use related laws and regulations.

Major recommendations proposed in the study are as follows: First, Law on Comprehensive Planning and Construction of the National Territory; Balanced Regional Development Act; and the Local Small and Medium Business Promotion Act; Capital Metropolitan Area Readjustment planning Law; Law on the Utilization and management of the National Territory; Land Expropriation Law; and the Special Act for the Land Acquisition for Public Use and Its Loss Compensation should be coordinated and integrated into the one 'Basic Law on Utilization and Management of the National Territory (a tentative title).' Second, Urban Planning Code; Building Code; Land Division Rearrangement Project Act; Urban Redevelopment Act; and Housing Site Development Promotion Act should all be incorporated into the one 'Urban Planning Law(a tentative title).' Third, Natural Environment Conservation Law; Rare Species Protection District Act; Historic Preservation Site Act, Bird Protection and Hunting Act as parts of the Cultural Heritage Preservation Law; and the Natural Park Law should all be incorporated into the one 'Natural Environment Management Law(a tentative title).' Fourth, Forestry Law; Grassland Law; Dairy Farm Promotion Act; Land-Slide Prevention Project Act; and the Law on the Burial and Graveyard should all be incorporated into the one 'Forestry Resources Management Law(a tentative title).' Fifth, Public Waters Management Law; Law on Land Fills in Public Waters; River Law; Waterway Law; Multi-Purpose Dams Law; Law on Dam Construction and Related Supports (legislation in process); and the Law on the Counter Measures Against Flood and Storm Damage should all be incorporated into the one 'River and Public Waters Law (a tentative title).' Sixth, Law on the Establishment of Foreign Free Investment Zones(legislation in process); Special Law on the Estavlishment of International Free Investment Zones (legislation in process); Law on the Establishment of Free Export Zones; Law on the Industrial Location and Site Development; and the Law on the Manufacturing Industries Location and Factory Construction should all be incorporated into the one 'Law on Industry positioning and Location (a tentative title).' Seventh, Motorway Law; National Highway Law; and the Road Maintenance Promotion Act should all be incorporated into the one 'Motorway Management Law (a tentative title).'
