고속도로 공공공사 용지 확보의 한계와 개선방안을 검토했다.

‘Public Construction works’ in Korea refer to public civil engineering and construction projects that are carried out by the national government, local governments, or government agencies as the owners, or with the support of local governments. The “Act On Contracts To Which The State Is A Party” establishes basic contractual matters to facilitate smooth performance of the contract work.

Meanwhile, in order to carry out public projects, the “Act On Acquisition Of And Compensation For Land For Public Works Projects” requires the project implementer to secure the land for the project, and the General Conditions of Public Construction Contracts also stipulates that the ordering agency shall secure the land for the project and deliver it to the contracting party until the date required for the performance of the project. However, incomplete or delayed land acquisition for the project often leads to frequent tunnel construction to comply with the completion deadline.

Therefore, this research aims to identify the problems with the current methods of securing land for public projects as stipulated by relevant laws and the General Conditions of Public Construction Contracts, and proposes solutions to alleviate the difficulties faced by the ordering agency and contracting party in securing the land for future public projects.
