지적과 등기제도의 공시일원화를 위한 법제 통합방향 연구

지적·등기제도의 공시 일원화를 위한 법제 통합방향을 제시했다.

현재, 우리나라는 부동산공시제도를 지적법에 의한 지적제도와 부동산등기법에 의한 등기제도의 이원화 구조로 운용하고 있다. 또한 토지와 건물도 각각의 부동산으로 분리하여 다루고 있다. 이로 인하여 부동산거래 및 국민의 재산권 보호에 지장을 초래하고 있으며, 국가의 효율적인 토지 관리에도 장애요소가 되고 있다. 본 연구에서는 이러한 이원화 체계하의 각각의 제도를 검토하여 효율적인 공시제도의 통합을 도모하고자 한다. 이를 위하여 외국의 선진화된 공시제도 현황을 고찰하여 우리나라 공시제도의 법제통합을 위해 선결되어야 할 사안들을 검토하였다. 결론으로는 공적장부에 대한 공신력의 인정, 지적재조사의 실시, 공시관련 법제의 정비 등을 근거로 한 공시제도의 통합방안을 제시하였다. Currently, Korea's real estate public announcement system is Two system operating of cadastre system and registration system. So real estate transactions and resulting harm to property rights protection, and efficient land management of the country are also obstacles.

In this research, each of these Two system operating by reviewing the system for effective public announcement system will want to promote integration. For this purpose, Public announcement system to the advanced study of foreign and to integrate the public announcement systems for the law to review the content has to be resolved first. Recognition public trust for the public books, Cadastral Renovation Project, Legal system maintenance on the basis of an integrated plan was presented in the conclusion.
