In accordance with the 「National Land Planning and Utilization Act」, the systematically allowed use ‘use area’, ‘specific use district’, and ‘use districts’ to be overlapped on one land is causing several problems.
This study aims to empirically analyze how overlapping regulations affect actual real estate transactions and derive system improvement measures. Although such overlapping designation is systematically permitted, there is a problem that the recognition of regulations by end users is limited due to the delivery method, visualization arrangement, and lack of commentary information within the disclosure system.
In particular, in the case of overlapping ‘development restricted areas’ and ‘natural green areas’, ‘urban natural park areas’ and ‘type 1 general residential areas’, there are cases in which they were collectively designated without going through a land adequacy evaluation at the time of designation of the use area. This acts as a background for instability between the strength of regulations and the contents of the disclosure.
The system has the legislative purpose of strengthening restrictions on behavior through duplicate regulations, but this purpose is not sufficiently reflected in the actual disclosure structure or information delivery method, which can cause confusion in the transaction process. To solve this problem, this study empirically analyzes the visual arrangement of the disclosure system, the regulatory writing method, and the structure of providing commentary information, and investigates the process of the overlapping designation structure leading to actual transaction confusion and damage.
Through this, the purpose of this study is to present policy improvement measures to increase the effectiveness of overlapping regulations and to secure the accuracy and reliability of information delivery. The study compared the gap between the disclosure information and the actual level of regulation through 'representative case analysis', and comprehensively utilized the Land Use Regulation Information Service (LURIS), GIS-based data, and aerial photography. In addition, interviews with transaction parties, brokers, and urban planning managers and surveys (50 questions in total) for experts and the general public were conducted in parallel to derive practical differences in perception.
This study recognized the overlapping designation problem as a problem of the information delivery system rather than a simple regulatory structure, and presented policy tasks including improving the visualization of weapon methods, strengthening the provision of commentary information, reorganizing the foundation for land adequacy evaluation in some areas, and flexible re-designation of use areas. Through this, it is intended to contribute to laying the foundation for more detailed regulatory design, stability of real estate transactions, and trust in the system at the same time.
