초록
A Study on the Protection of Unit Buyers in Sale Contracts for Condominium Buildings - Focusing on Alternative Dispute Resolution - This study aims to analyze the types and causes of damages suffered by buyers in sale contracts for condominium buildings and to explore effective buyer protection measures centered on Alternative Dispute Resolution (ADR) systems. As Korea underwent rapid economic growth and urbanization, housing shortages emerged as a significant social issue, prompting the government to implement various policies to expand housing supply.
The pre-sale system introduced in 1984, which reduces the financial burden on developers while enabling the rapid provision of large quantities of housing, has become the primary supply mechanism in the Korean housing market. However, this system structurally generates information asymmetry between developers and buyers.
Because buyers rely on limited information—such as design drawings, sales advertisements, and model houses—regarding buildings that have not yet been completed, they become vulnerable to false or exaggerated advertising, defects, and other forms of buyer harm. Condominium buildings are generally classified into multi-family housing and non-residential condominium buildings depending on their use.
While buyers of multi-family housing benefit from relatively strong legal protections under statutes such as the Housing Act and the Multi-Family Housing Management Act, buyers of non-residential condominium buildings—such as commercial units and officetels—may fall into legal blind spots.
Excluding buyers from protection solely based on the use of the building does not sufficiently take into account the structurally disadvantaged position of buyers, who lack information and bargaining power relative to developers. Litigation has traditionally been used to resolve disputes arising from sale contracts for condominium buildings, but it involves lengthy procedures, substantial costs, and limited expertise and flexibility. In particular, disputes involving defects in condominium buildings often require specialized technical knowledge, making rapid and effective resolution difficult through judicial proceedings alone.
To address these limitations, various administrative ADR bodies—such as the Consumer Dispute Mediation Committee, the Condominium Building Dispute Mediation Committee, and the Defect Examination and Dispute Mediation Committee—have been established in Korea. However, because the scope of mediation, procedures, and legal effects differ across these institutions, buyers frequently face difficulties in choosing an appropriate remedy.
Accordingly, improvements in overall system effectiveness are needed. This study examines the definition and types of sale contracts for condominium buildings, reviews relevant Korean laws and systems together with foreign sales systems, presents cases of buyer harm arising from such contracts, and analyzes defect-related disputes by defect type handled by the Ministry of Land, Infrastructure and Transport. It further examines the roles, procedures, and legal effects of major ADR institutions related to sale contracts for condominium buildings.
The study proposes several improvements: (1) strengthening the legal effect of mediation by granting mediation decisions of the Condominium Building Dispute Mediation Committee the same legal effect as judicial settlements; (2) expanding the jurisdiction of the Defect Examination and Dispute Mediation Committee to include condominium buildings other than multi-family housing; (3) introducing partial mandatory mediation for small claims and adopting a prohibition on withdrawal to litigation to promote the use of ADR; and (4) enhancing the human and material resources of ADR institutions and strengthening mediator expertise through systematic training.
