英國의 地區單位 建築 콘트롤 制度에 관한 硏究 : Local Plan과 Planning Permission System의 특성분석

영국의 지구단위 건축 규제와 계획허가 제도를 분석했다.

현재 한국의 도시계획제도는 법체계의 모순으로 말미암아 여러 가지 문제점을 내포하고 있다. 특히 도시계획법과 건축법의 중간영역에서 양 계획간의 매개 역할을 담당해야 할 지구 단위 건축 규제의 부재로 인하여 점점 다양해지고 복잡한 양상을 나타내는 도시내 토지 이용을 효과적으로 콘트롤하지 못하고 있으며 쾌적하고 기능적인 도시환경 조성도 기대하기 힘든 실정이다. 이러한 상황아래에서 정부에서는 도시설계지구나 상세계획구역 등 특별지역·지구의 지정을 통하여 지구단위 건축 콘트롤의 시행을 도모하고 있지만 현재 그 결과는 만족할 만한 수준에 이르지 못하고 있다. 본 연구는 현재 선진외국에서 일반화 되어있는 지구단위 건축 콘트롤 제도 중에서 매우 독특하고 합리적인 방식으로 운용되고 있는 영국의 Local Plan과 Planning Permission System에 관하여 그 내용과 시행절차 그리고 시행상 문제점 등을 고찰해 봄으로서, 이 제도가 가지는 특징적인 요소들을 도출하는데 주안을 두고 진행되었다. 그리고 이러한 특징적인 요소들이 현재 매우 미비하게 운용되고 있는 한국의 지구단위 건축규제에 시사하는 바는 무엇이며, 궁극적으로 앞으로 한국에서 보다 합리적이고 효율적인 지구단위 건축 콘트롤 제도가 확립될 수 있도록 기초자료를 제공하고 이를 통해 현행 제도의 개선방향을 제시하는데에 연구의 목적이 있다.

본 연구는 총 5개 장으로 구성되어 있으며 각 장의 주요내용과 그 결과를 요약하면 다음과 같다. 제1장은 서론으로서 연구의 배경과 목적 그리고 연구의 방법 과 범위 및 연구의 진행과정에 대하여 기술하였다. 제2장에서는 본 논문에서 다루게될 지구단위계획과 지구단위 건축 콘트롤에 관련한 기본개념들과, 연구의 방법론을 모색하 기 위한 기본적인 고찰로서 도시계획내에서의 지구단위 건축 콘트롤 제도가 갖추어야 할 '제도'로서의 성격과 기능은 어떠해야 하는가를 정리하고 그에 따른 제어요소 및 형식 등을 검토하였다. 제3장에서는 연구의 주대상국인 영국에서 도시 계획이 어떤 과정을 통해 발전해 왔으며, 변천에 따른 역사적인 배경은 무엇인지를 고찰하고, 현재 어떠한 체계와 위계를 가지고 지역 및 도시계획이 실현되고 있는지를 종합적으로 검토하여 영국 도시계획제도의 골격과 그 특징들을 파악하였다. 제4장에서는 영국의 도시계획제도 중에서 지구단위 건축 콘트롤의 개념을 가지고 시행되고 있는 Local Plan과 계획허가제도(Planning Permission System)를 그 법제적 내용과 행정적 절차에 관하여 근거법과 행정치침서 등을 통해 상세히 고찰해 보고, 실제 적용되고 있는 실례를 사례 연구를 통해 실증적으로 검토해 봄으로서 그 특징적 요소들을 도출하였다.

그리고 이 내용을 지구상세계획제도를 중심으로 한 독일의 관련제도와 다각적으로 비교·분석해 봄으로서 상대적인 장단점을 통해 영국 제도의 특성을 확인하였다. 제5장은 결론으로서 각장에서 확인된 결과들을 종합하고 이를 통하여 향후 우리나라의 지구단위 건축규제제도가 개선해야할 방향을 모색하였다. There are many problems in the urban planning system, at present, of Korea on account of the inconsistency of the Act Organization. Especially, because of absence of the District Units Building Control System which should play an important and intermediate role betweenthe Urban Planning Act and the Building Act, the building control system has not operate effectually to the urban land use showing the tendency to more various and complicate, and the creation of comfortable urban space is difficult to be expected.

In this circumstance, the government tried to enforce the District Units Building Control System through the establisgment of special District'Area such as a 'Special Block Rehavilitation Zones(SBRZ)', 'Urban Renewal Blocks(UBR)' and 'Urban Design Zone(UDZ)'. But the results of them are not enough. This study is to research and investigate the District Units Building Control System of England operated and used with unique and reasonable method, through appreciation of the contents of them, analysis of the medeling case study and pick out the characteristic factors of them. So.

the purpose of this study is to find out the problems of the District Units Building Control System of Korea, extremity, to offer a fundamental data and to show up the improvemental method for the establishment of that. This study is composed of five chapters, and the main contents of the study and the summary of the results in each chapter are as follows ; In chapter 1, describing the purpose, scope, methods, progress and main concepts of this study, as a introduction.

In chapter 2, as an basic investigation to fundamental concepts of the District Units Building Control System and to the method of the study, arranging the characteristics and function and investigated the control elements and form of that system. In chapter 3, describing the framwork and characteristics of English urban planning system at present through the examination to the process and historical background of urban planning and the synthetical investigation to the system and hierachy of urban planning and land use in England.

In chapter 4, Seeking out the characteristic elements of the District Units Building Control System in England through the examination to the 'Local Plan' and the 'Planning Permission System' which are taking effect as a concept of the 'District Units Building Control' in England with investigation to the contents, enforcemental methods and administrative procedure of that and the verification of them by the case study in the City of Newcastle upon Tyne. And making an analysis of these characteristic elements with the comparision to the 'Bebauungplan' which is District Units Building Control System of Germany In chapter 5, summerizeing the above contents as a conclude.
