초록
In my opinion, there is an obstacle when we try to solve problems of the limited development district. During the dictatorship ear in Korea, the political system didn't allow people to have different ideas or perspectives regarding to government's policy. However, nowadays it is impossible that government just inquire people to have disadvantages because of their policy and that's how property owners think. As a result, there is a premise that it is not possible to have a policy fair for all citizens and an alternative adjusting the interest of all property owners.
While making the limited development district, there were errors in the making process and in contents, but everybody agreed that we needed to have that system. I t has had several advantages so far such as people couldn't develop the green tract of land in the metropolitan area so that it has been positive for environmental problems and urban sprawl. It is generally considered that if people could develop the land continuously without any regulation, we might have devastation due to a lack of construction site in Korea. Consequently, we have to pay more money and sacrifice ourselves.
Even though there were errors in the making, we need to makea long term view detail plan in the limited development district areas. As a result, the limited development district is going to be the vision of the land system in Korea. Before making a policy, first of all, we need to decide whether to make a policy depending on advantages of the limited development district or the infringement of the right of private property, because which way we decide is going to be the basis of the limited development district. Consequently, we can anticipate the future of the limited development district and don't have any more property owners having disadvantages because of this regulation.
At the moment, we have more land speculation in the limited development district compared to other areas. Due to land speculation the use of the limited development district areas has been totally different from its purpose of the legislation and it hurts the intent of the law. From now governmenthas to make sure that people cannot abuse the limited development district areas and stop the devastation in the limited development district areas.
The profits from the development of low density high-class residential property and material circulation development have to be used to pay compensation for property owners before designation or property owners having disadvantages and to have base facilities and street-widening in Hanam city. While studying in this field, it has been difficult to research statistical data and there is even a discrepancy between research data of ministry of construction & transportation and that of Gyeonggi Province, which cause a major obstacle to research data. As a result, I have to be on the spot to analyze and research market.
It has been allowed to build a stable in the limited development district areas so that they can have an occupation, but as far as I know, it is not a good idea to have the business of stock breeding in the metropolitan areas because the return of equity is smaller that other business. After 1995, most farmers built a stable in order to change to a warehouse or plant illegally and it has caused a lot of environmental problems because it didn't have enough facilities and it was not licensed, which means government couldn't regulate and control.
From now, if there is no management from government, most of the limited development district areas would turn to a warehouse and there would be devastation and a lot of environmental problems. Government has tried to solve these obstacles, but there has been no agreement between ministries of government. Consequently, solutions for the limited development district were not the real solution.
The devastation of the limited development district areas caused by changing a stable to a warehouse and plant should be solved as soon as possible and government should have a strong regulation that people in the limited development district areas cannot change a stable to a warehouse and plant any more. It is also recommended to develop a material circulation and low density building site in the limited development district areas. All those works are how government develops the limited development district efficiently and a positive response to the demand of the site.
In my personal opinion, government has to investigate how many warehouses have been changed illegally and analyze what kind of problems there are so that they can fix it. Eventually, government makes sure that there is no use of diversion in the limited development district areas. It is a good idea to have a task force temporarily to investigate because government doesn't have enough employees. It is also good to have a separate team to find good solutions for the problems in the limited development district. Penal clauses of the limited development district have been increased since it was legislated, but there was no management.
As a result, people couldn't believe government any more and illegal changes in the limited development district have been getting worse. It is not a good idea to modify the system of the limited development district and it is recommended to keep having this system and try to find decent solutions. Finally, this study has been quite different from other studies because it has several personal opinions. It also has a limit that this study is just for all practical purposes and research data is not up-to-date. I hope there is going to be more studies related to this study after.
