Conservation Easement in US has been acknowledged as voluntary, effective means of preserving private lands while upholding private stewardship, private initiative and the rights of private property owners. Conservation Easements allow landowners to hold on to and use their property but permanently limit uses of land to protect its conservation values. This paper examines the history, the characteristics of Conservation easement in U.S and adoption in other countries like Canada and Chile.
Then this provides how to adopt this preservation tool in South Korea without alteration of Korean current legal structure. Most of the Korean domestic literature were negative for adopting Conservation Easements because they thought it would depend on whether it is possible to separate development rights from property ownership. In Property Law of Korea, the right of ownership is described as an absolute dominance over the object, not in a view of bundle of rights. So it is considered impossible to separate some rights from ownership because it is contrary to dominating nature of owenrship.
A limited real right, however, is defined as Usufruct, and easement is a sort of Usufruct in Koran civil law. Even though, in Korea, easement in gross is never allowed and easement has rarely been used, except for a-right-way easement, conservation easements can be adopted as appurtenant easement which runs with the dominant estate. We have used the strict public regulations to control development of private land. Up to now, there are huge amount of private lands in protected area designated by the Korean government. That is causing strong backlash against management of protected area, claiming excessive infringement of property rights.
That is where Conservation easement can be used as the tool of both cooperation management and compensation method in private lands in Korean protected area. This study shows the possibility to practice conservation easements in Korean civil law and proposes the suitable model to Doline Wetland, the 23th designated wetland protected area in Korea. Government, as the dominant estate owner, can acquire conservation easements on some private lands, and then assign their management to 'National Trust of Natural Environment' under 'Act on the National Trust of Cultural Heritages and National Environment Assets'.
N.T.N.E, however, is the statutory corporation under government controls and there is no organization in Korea such as American land trust. In conclusion, this study suggests that Government holds the conservation easement and N.T.N.E takes over the management of private lands in Doline wetland protected area. Conservation easement can improve the awareness that conserving land contributes to protecting environment, solve the conflict of private within protected areas and enhance the voluntary protection in Korea. That's why we need to consider conservation easements positively as legal tool in Korea.
