충청북도 토지이용규제 실태분석

충청북도의 토지이용규제 지정 현황과 중첩 실태를 분석했다.

The purpose of this study was to conduct an analysis of the current state of land use regulations in Chungcheongbuk-do, with the aim of deriving implications for improving the land use regulatory system for rational and sustainable land utilization. To achieve this, an analysis was conducted on the designation status of areas and zones, spatial overlap status, and conflicting and similar-purpose areas and zones, focusing on Chungcheongbuk-do where a comprehensive analysis of land use regulations had not been conducted previously. The analysis results revealed the following findings.

First, among the 335 designated areas and zones operated in accordance with the Basic Act on Land Use Regulations in Chungcheongbuk-do, a total of 138 areas and zones were identified, with an average of 4.48 areas and zones designated per region. Second, the spatial overlap analysis of the 138 designated areas and zones in Chungcheongbuk-do indicated that more than two areas and zones overlapped in 88.5% of the total area, five or more overlapped in 65.0%, ten or more overlapped in 19.6%, and fifteen or more overlapped in 4.8%. Lastly, the analysis of conflicting and similar-purpose areas and zones revealed the presence of overlapping regulations in certain regions of Chungcheongbuk-do.

Despite the simplification, transparency, and computerization efforts achieved through the enactment of the Basic Act on Land Use Regulations in 2005, there are still 335 designated areas and zones nationwide, with 138 areas and zones being designated and operated in Chungcheongbuk-do. Furthermore, there are instances of conflicting and similar-purpose areas and zones overlapping. This analysis highlights the need for monitoring land use regulations through an examination of the designation status and operational conditions of areas and zones, in order to facilitate effective improvements in the land use regulatory system.

본 연구는 토지의 합리적이고 지속가능한 이용을 목적으로 운영되고 있는 토지이용규제의 실태분석을 통해 토지이용규제 제도개선을 위한 시사점 도출을 목적으로 하였다. 이를 위하여 토지이용규제 실태분석이 선행되지 않은 충청북도를 대상으로 지역・지구 등의 지정현황, 공간중첩 현황, 불부합 및 유사목적 지역・지구 등의 중첩규제 현황을 분석하였다. 분석결과 첫째, 충청북도에는 토지이용규제 기본법 에 의하여 지정 및 운영되고 있는 335개의 지역・지구 가운데 138개의 지역・지구 등이 지정되어 있으며, 평균 4.48개의 지역・지구 등이 지정되어 있었다. 둘째, 충청북도에 지정되어 있는 138개의 지역・지구 등의 공간중첩 분석을 수행한 결과 2개 이상의 지역・지구 등이 중첩된 면적은 전체면적의 88.5%, 5개 이상은 65.0%, 10개 이상은 19.6%, 15개 이상은 4.8%인 것으로 분석되었다. 마지막으로 불부합 및 유사목적 지역・지구 등의 중첩규제 현황을 분석한 결과 충청북도 일부 지역에서 불부합 및 유사목적 지역・지구 등의 중첩규제가 존재하는 것으로 분석되었다.

2005년 토지이용규제 기본법 의 제정으로 토지이용규제의 단순화・투명화・전산화가 일부 이루어졌음에도 불구하고 여전히 전국적으로는 335개의 지역・지구 등이, 충청북도에는 138개의 지역・지구 등이 지정 및 운영 중에 있으며 불부합 및 유사목적 지역・지구 등의 중첩규제 지역이 존재하는 것으로 분석되었다. 이는 실효성 있는 토지이용규제의 제도개선을 위해서는 지역・지구 등의 지정현황 및 운영 실태분석을 통한 토지이용규제의 모니터링이 필요함을 시사한다.
