地下空間開發과 所有權의 限界 關한 硏究

지하공간 개발에 따른 토지 소유권의 범위와 한계를 연구한다.

Some of the most telling characteristic of the underground space are various protections from climate, a disaster, a noise and an insight from the outside. Important facilities and historical remains can be stored in the underground space, and a traffic jam can be eased through subway system. The Seoul City made three provisions as parts of a plan of underground space development. 1. To establish public hole or tunnel to provide enough room to underground traffic and various underground layings. 2. To secure underground areas for housing, office, entertainment, storage parking and various purposes, and to connect those facilities to the on-the-ground facilities.

Important, to secure enough green areas on the ground. 3. To promote constructions of so called NIMBY facilities: a sewage disposal plant, a waste disposal plant, a water teratment pIant. Many problems arise from the underground space use. 1. In a legal standpoint, it is unavoidable to limit one's right to the underground. 2. In an environmental point, natural light, public facilities, and sightings are easily lack. Also, a disorientation and claustophobia can happen. 3. In a technical point, a lot of technical knowledge is necessary in geology, structure safety and management. 4. In an economic point, the underground space development serves a lower cost than on the ground. 5.

In the point of a policy, the underground space development plan should be regared as one of the most important part of the land development plan.
