토지수용에 따른 보상제도 개선방안에 관한 연구 : 경기도 하남시 보금자리주택지구 중심으로

보금자리주택지구의 토지수용 보상제도와 이주대책 개선을 연구했다.

현 정부가 들어오면서 도시화로 인한 토지이용에 대한 공급확대 요구와 보금자리주택의 건설, 이용자 중심의 토지이용 규제 개혁으로 주택․토지의 가격 안정을 취하고 있지만, 서울 강남구, 서초구, 경기 하남시와 같이 개발압력이 높은 수도권 주변에 있는 택지에 대해서는 세밀한 분석을 통해 보상계획을 세우고 이주대책을 반드시 확립해야 한다. 그러나 보상을 하기위한 감정평가 제도와 토지보상제도의 조정을 위한 다양한 이론들과 정책을 제시 했음에도 많은 문제점이 발생하고 있다. 현 정부는 보금자리주택 및 공․공 임대주택 건설을 한다는 목적으로 일정수준까지 공급을 확대해야 한다는 명분을 가지고 있지만, 실질적으로 토지를 수용당하고 삶의 터전을 잃고 이주해야 하는 원주민들의 상황반영도 제대로 되지 않고 있다. 이를 전제로 하여 본 연구에서는 토지보상제도와 시세대비 손실보상 금액의 인식을 확인하고 문제점을 검토하여 하남시 보금자리 주택지의 정당한 보상과 공익사업의 기준에 대한 이론적 부분을 확립함으로써 토지보상법에 따라 수용하는 사업에 관한 토지보상제도의 문제점을 파악하고 대안을 제시하는데 목적이 있다.

Although the new Lee Myung Bak administration has been putting efforts on price stabilization of housing and land by means of the demand for the expanded supply of the urbanized land use, construction of Bogeumjari housing, and user-oriented innovation of land use regulations, it is necessary to analyze the land around such metropolitan area where there is strong pressure for the development as Gangnam-gu and Seocho-gu in Seoul and Hanam City in Gyeonggi-do and plan the compensation system and measures for resettlement.

However, the suggestion of varied theories and policies for the adjustment of the appraisal system and the land compensation system intended for general compensation is also causing numerous problems. The current government justifies that it has to expand the supply to a certain degree for the purpose of constructing Bogeumjari housing and public rental housing but it is not even practically reflecting the situation of the native people whose land has been expropriated and who have to leave their homes.

Based on the premise above, this study is intended to examine the perception and problems of the land compensation system and the compensation amount compared to the market price and reestablish theories on the standards of the fair compensation of Bogeumjari housing area in Hanam City and public services. This will lead to identify the problems of the land compensation system for the project which expropriates the land according to the Land Compensation Law and suggest alternatives.
